This indenture made the first
day of May in the year One thousand eight hundred and fifty eight
Between James Crowther and Harriet his wife of the town of Esopus in the
County of Ulster and State of New York parties of the first part and
Joseph Greaves of the town of Marlborough County and State aforesaid
party of the second part
Witnesseth that the said parties of the first part in consideration of
he sum of seven thousand dollars to them duly paid have sold and by
these presents do grant and convey to the said party of the second part
and to his heirs and assigns forever
All
of that certain piece or parcel of farm land situate in the aforesaid
town of Esopus and known as the Homestead of John Beaver deceased and is
bounded as follows viz
On the north by lands belonging to the heirs of Nicholas Murphy decd and
the Factory lot on the east by the lands of Robert L Pell & John O
Beaver on the south by land of said John O Beaver & Archibald
Russell and on the west by the said Factory lot & Cornelius Relyea
containing about seventy one acres of land be the same more or less
Being
the same premises that was conveyed to the said party of the first part
by Philip Tandy and George Greaves by deed bearing date the twenty third
day of April one thousand eight hundred and fifty, and was recorded in
the Ulster County Clerks office Book of Deeds No 75 on pages 679 on the
2nd day of May 1850 at 12 noon with the appurtenances and all the estate
title and interest dower and right of Dower of the said parties of the
first part therein. And the said James Crowther for himself and his
heirs does hereby covenant and agree that at the delivery hereof he is
the lawful owner of the premises above granted and seized of a good and
indefectible estate of inheritance therein clear of all encumbrances
Except one certain indenture of mortgage to secure the payment of eight
hundred dollars with the interest which said sum together with the
unpaid interest the said party of the second party hereby assumes the
payment of and is to be considered as so much of the consideration money
first above mentioned.
Also subject to the unexpired terms of the deeds (if any) of that part
of the above described premises now occupied by Harriet McCleary
consisting of the Grist mill but the said party of the second part is to
have the rents, issues & profits thereof and that he will warrant
and defend the above granted premises in the quiet and peaceable
possession of the said party of the second part, his heirs and assigns
forever except as aforesaid.
In witness whereof the said parties of the first part have hereunto set
their hands and seals the day and year first above written

On this 7th day of May in the year 1858 before me personally came James
Crowther & Harriet his wife the said James Crowther being known to
me to be the same person described in and who executed the written
conveyance and the said Harriet being proven to me satisfactorily to be
the same person described in and who executed the conveyance by the oath
of James Armitage who being by me duly sworn did depose & say that
he resided in the town of Marlborough in said county of Ulster that he
know the said Harriet to be the wife of the said James Crowther and that
he knew her to be the same person described in & who executed the
said conveyance & whereupon the said Harriet & James Crowther
severally acknowledged that they executed the said conveyance the said
Harriet acknowledged to me on a private examination by me made apart
from her husband that she executed the same freely and without any fear
or compulsion of him. I also certify that the words ‘dower & right
of Dower part’ were interlined before the deed was executed.
