George and Anna Pratt to Robert Pell - tract in Hardenburgh Patent |
| This Indenture, made the
Sixteenth day of January in the year one thousand eight hundred and
sixty between George W Pratt and Anna T Pratt his wife of the town of
Kingston County of Ulster State of New York of the first part, and
Robert L Pell of Pellham town of Esopus, County and State aforesaid
party of the second part. Witnesseth that the said parties of the first part, for and in consideration of the sum of One Dollar lawful money of the United States of America to them in hand paid by the said party of the second part at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged have granted, remised, released and quit claimed and by these presents do grant, remise, release and quit-claim unto the said party of the second part and to his heirs and assigns forever All
that certain tract of land situate in the town of Denning (being part of
the Great Lot No Six in Hardenburgh Patent): Excepting and reserving all the hemlock bark on said tract with the right to enter upon said lot at any time within two years and remove said bark. Also reserving the right of a road across said lot known as the Rondout Road. Also excepting & reserving the lots sold to Southwick Cail – Albert MacKey, Nathan H Spencer, Daniel Spencer and Sylvester Bartholomew. Being the premises intended to be conveyed to the party of the second part by instrument executed by the said parties of the first part under date of May fourth one thousand eight hundred and fifty nine and Recorded in the Office of the Clerk of the County of Ulster on the twelfth day of January, one thousand eight hundred and sixty. This conveyance being executed in consequence of an omission in the description of the premises aforesaid in said first mentioned instrument. Together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in any way appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof. And also all the estate, right, title interest, dower and right of dower, property, possession, claim and demand whatsoever, and as well in law as in equity of the said parties of the first part of in or to the above described premises, and every part and parcel thereof with the appurtenances. To have and to hold all and singular the above mentioned and described premises, together with the appurtenances unto the said party of the second part his heirs and assigns forever. In witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written. Pratt and Anna T. Pratt personally known to me to be the same persons described in and who executed the within instrument and they and each of them acknowledged before me, the execution of the same and the said Anna T. Pratt on a private examination had by me, separate and apart from her said husband, acknowledged before me, that she executed the same freely and her own free act and deed and without any fear or compulsion of or from her said husband. Joseph Hayes, Comr of Deeds State of New York } City and County of New York } I, John Clancy, Clerk of the City and County of New York and also Clerk of the Supreme Court for said City and County being a Court of Record Do hereby certify that Jos Hayes whose name is subscribed to the certificate of the proof or acknowledgment of the annexed instrument and thereon written was at the time of taking such proof or acknowledgment a Commissioner of Deeds for said City and County dwelling in the said City, commissioned and sworn and duly authorized to take the same. And further that I am well acquainted with the handwriting of such Commissioner and verily believe that the signature to the said certificate of proof or acknowledgment is genuine. I further certify that said instrument is executed and acknowledged according to the laws of this state as appears by said certificate. |
