Joseph and Nanney Greaves to Robert L Pell

This Indenture made the first day of April in the year one thousand eight hundred and sixty between Joseph Greaves and Nanney his wife of the town of Marlborough and County of Ulster State of New York parties of the first part and Robert L. Pell of the town of Esopus County of Ulster and State aforesaid party of the second part

Witnesseth that the said parties of the first part for and in consideration of the sum of seven thousand seven hundred dollars lawful money of the United States to them in hand paid by the said party of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged and the said party of the second part his heirs executors and administrators forever released and discharged from the same by these presents have granted bargained sold aliened remised released conveyed and confirmed and by these presents do grant bargain sell alien remise release convey and confirm unto the said party of the second part and to his heirs and assigns forever

All that certain piece or parcel of land situate in the town of Esopus and County of Ulster and known as the homestead of John Beaver deceased and is bounded as follows:

On the north by lands belonging to the heirs of Nicholas Murphy & the Factory Lot on the East by lands of Robert L Pell and John Oliver Beaver on the South by lands of the said John Oliver Beaver and Archibald Russell and in the West by said Factory lot and Cornelius Relyea containing about seventy one acres of land be the same more or less; being the same premises that were conveyed to the said party of the first part by James Crowther and Harriet his wife by deed bearing date the first day of May one thousand eight hundred and fifty eight recorded in Book of Deeds No 103 on page 599 May 16th 1858.

Together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof: And also all the estate right tit6le interest dower & right of dower property possession claim and demand whatsoever as well in law as in equity of the said parties of the first part of in and to the same and every part and parcel t6hereof with the appurtenances: 


To Have and To Hold the above granted bargained and described premises with the appurtenances unto the said part of the second part his heirs and assigns to their own proper use benefit and behoof forever. Subject nevertheless to several mortgages, judgments as recorded at Kingston in the County of Ulster and State of New York which said party of the second part agrees to pay off, cancel, and discharge of record and to hold said Greaves harmless and safe therefrom. And the said Joseph Greaves & wife for themselves their executors and administrators do covenant grant and agree to and with the said party of the second part his heirs and assigns that the said Joseph Greaves at the time of the sealing and delivery of these presents was lawfully seized in and of a good absolute and indefeasible estate of inheritance in fee simple of and in all and singular the above granted and described premises with the appurtenances except as above mentioned and have good right and full power and lawful authority to grant bargain sell and convey the same in manner aforesaid.

And that the said party of the second part his heirs and assigns shall and may at all times hereafter peaceable and quietly have hold use occupy possess and enjoy the above granted premises and every part and parcel thereof with the appurtenances without any let suit trouble molestation eviction or disturbance of the said parties of the first part their heirs or assigns or of any other person or persons lawfully claiming or to claim the same. And that the same now are free clear discharged and unencumbered of and from all former and other grants titles charges estates judgments taxes assessments and encumbrances of what nature or kind soever except as aforesaid. And also that the said parties of the first part and their heirs and all and every person or persons whomsoever lawfully or equitable deriving any estate right title or interest orf in or to the hereinbefore granted premises by from under or in trust for them shall and will at any time or times hereafter upon the reasonable request and at the proper costs and charges in the law of the said party of the second part his heirs and assigns make do and execute or cause to be made done and executed all and every such further and other lawful and reasonable acts conveyances and assurances in the law for the better and more effectually vesting and confirming the premises hereby granted or so intended to be in and to the said party of the second part his heirs and assigns forever, as by the said party of the second part his heirs or assigns or their counsel learned in the law shall be reasonably advised or required. And the said Joseph Greaves and wife their heirs the above described and hereby granted and released premises and every part and parcel thereof with the appurtenances unto the said party of the second part his heirs and assigns against the said parties of the first part and their heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same shall and will warrant and by these presents forever defend.

On the seventh day of May in the year one thousand and eight hundred and sixty before me personally came Joseph Greaves and Nanney his wife to me known to be the individuals described in and who executed the foregoing instrument and severally acknowledged that they executed the same; the said Nanney on a private examination by me made separate and apart from her husband acknowledged that she executed the said instrument freely and without any fear or compulsion of him.
