WITNESSETH, that the party of the first part, in consideration of TEN and No/100 ($10.00) dollars, lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, All. that certain plot, piece or parcel of land, lying and being in the Town of Esopus, County of Ulster, State of New York, more particularly bounded and described as follows: BEGINNING at a steel survey marker set in the southerly boundary of the lands of Wildwycke Village, Inc. at the intersection of the said boundary with the westerly boundary of the New York State highway (Route 9W); thence North 21 degrees 38 minutes West along the said highway boundary 431.82 feet to a steel pin; thence South 82 degrees 17 minutes West 62.65 feet to a steel pin; thence North 25 degrees 08 minutes West 446.45 feet to a steel pin; thence North 58 degrees 08 minutes West 154.71 feet to a steel pin; thence North 82 degrees 08 minutes West 266. feet, plus or minus, to the shoreline of Black Creek; thence southerly along the said shoreline 605 feet, plus or minus, to a point in the aforementioned southerly boundary of the lands of Wildwycke Village, Inc., said point being 8.6 feet distant, plus or minus, measured on a bearing of North 6.6 degrees 55 minutes 50 seconds West from a steel pin; thence along the old wire fence and stone wall marking the said boundary as follows: South 66 degrees 55 minutes 50 seconds East 60 feet, plus or minus; and thence South 66 degrees 45 minutes 20 seconds East 740.3 feet; and thence South 67 degrees 21 minutes 30 seconds East 376.99 feet; and thence South 65 degrees 52 minutes 40 seconds East 99.90 feet to the point of beginning, containing 10.4 acres of land, be the same more or less. BEING a part of the premises conveyed by Walrus, Inc. to Phillip P. Hellriegel and James R. Shields by deed dated November 5, 1968, recorded November 8, 1968 in the Office of the Clerk of Ulster County in Liber 1220, Page 448 and thereafter conveyed by Phillip P. Hellriegel and James R. Shields to c4ildwycke Village, Inc. by deed dated August 12, 1969 recorded September 11, 1969 in the Office of the Clerk of Ulster County in Liber 1232, Page 1178. SUBJECT to a restriction that the
property may be used for any commercial purpose except that if said
property is used as a restaurant, such restaurant shall be a Japanese
type restaurant. Together with an easement to the
Purchasers for a right of way, entrance of the property of the Seller. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be constr5ued as if it read "parties' whenever the sense of this indenture so requires IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written. Hellriegel to me known, who, being by me duly sworn, did depose and say that he resides at No. Box 92, Route 9W, Esopus, New York, that he is the President of Wildwycke Village, Inc. the corporation described in and which executed the foregoing instrument; that he knows the seal of said corporation; that the seal affixed to said instrument is such corporate seal; that is was so affixed by order of the board of directors of said corporation, and that he signed his name thereto by like order (signed but signature indecipherable) Filed 3: 09 PM, Aug 3, 1972
