Partial Release of Real Estate Mortgage

KNOW ALL MEN BY THESE PRESENTS:

That U. S. SMALL BUSINESS ADMINISTRATION, an Agency of the United States Government, duly created by an Act of Congress, having its principal office in Washington, D. C. and a Regional Office at 26 Federal Plaza, New York, New York 100007, in consideration of One ($1.00) Dollar and other good and valuable consideration, receipt whereof is acknowledged,

DOES HEREBY RELEASE and discharge the real property, hereinafter particularly described, from the lien of a certain Real Estate Mortgage, dated the 29th day of October, 1980, made and executed by Peter Brill, of Anchorage 207 Columbia Route 6, St. Thomas, Virgin Islands to U. S. SMALL BUSINESS ADMINISTRATION, in the principal sum of $ 150,750.00 and recor5ded on the 19th day of November 1980 in Liber 1174 of Mortgages, at page 667 in the Office of the Clerk of Ulster County, State of New York

The real property released from said Mortgage is particularly described as follows:


ALL that portion of Parcel B of those lands situate in the Town of Esopus, County of Ulster, and State of New York, which were conveyed to Peter Brill from U.S. Small Business Administration by deed dated Oct. 29,1980 and recorded in the Ulster County Clerk's Liber 1174 of deeds at page 667 that are bounded and described as follows:

 BEGINNING at a point on the westerly line of Parcel B aforesaid, which line is also the easterly line of lands now or formerly of Freer and which point lies North 20 degrees-14'-00" East, 315.24 feet from the center of West Park Road as measured along said easterly line of Freer.

THENCE from the said point of beginning northerly along the easterly line of the said lands of Freer North 20 degrees-14'-00" East, 406.65 feet and North 50 degrees-48'-50" East, 663.12 feet, to the corner of two wire fences and the southerly line of land now or formerly of Kataski7 thence running along the southerly line of said land of Kataski and part of the way along the centerline of a stone wall, the following courses and distances:

South 69 degrees-23'-20" East 183.85 feet;
South 68 degrees-51'-20" East 192.94 feet;
South 69 degrees-22'-20" East 131.84 feet;
South 69 degrees-23'-30" East 316.19 feet;
South 68 degrees-25'-00" East 167.27 feet;
South 69 degrees-08'-00" East 176.27 feet;
South 66 degrees-46 '-40" East 229.69 feet;
South 74 degrees-45'-50" East 141.98 feet;  and
South 68 degrees-30'-40" East 442.36 feet 

to a point; thence through the aforesaid lands as so conveyed to Peter Brill  South 21 degrees-00'-00" West, 986.03 feet; and North 69 degrees-00'-00" West, 2305.71 feet to the point or place of beginning, containing 50 acres.

 TOGETHER WITH a right-of-way for access, 50 feet wide over a portion of the remaining lands of Peter Brill, which lies immediately adjacent to the easterly line of the lands of Freer as above described, which right-of-way is bounded and described as follows:

 BEGINNING at the point where the easterly line of lands of Freer intersects the centerline of West Park Road as it is described in the above referenced conveyance to Peter Brill.

 THENCE from said point of beginning northerly along the said Freer lands North 20°-14'-00" East, a distance of 315.24 feet to the southerly line of the above described premises; thence along the said southerly line South 69°-00'-00" East, a distance of 50.00 feet to a point;. thence through the said lands of Peter Brill South 20°-14'-00" West, a distance of 435.88 feet to the center of West Park Road7 thence along the said center of West Park Road North 08°-24'-50" West a distance of 87.00 feet  North 09°-47'-00" East, a distance of 45.72 feet to the point or place of beginning. 

 This release shall not modify, affect or impair the terms, conditions and security of the said real estate mortgage except to release the real property hereinabove specifically described, and the ADMINISTRATION expressly retains the remainder of the mortgaged real property as security fcr the payment of said mortgage and the indebtedness therein mentioned.

 IN WITNESS WHEREOF, U.S. SMALL BUSINESS ADMINISTRATION has caused this instrument to be signed by Alfred Tayne, Supervisory Loan Officer, P/M/D,  Branch,  New York Regional office, Region II. thereunto duly authorized this 22 day of December 1981
