THIS INDENTURE, made the 9th day of September nineteen hundred and eighty-two between Fred J. Lafko, Pine Hill Road, Pleasant Valley, NY 12569, party of the first part, and JAF Partners, Inc., a domestic corporation of the State of New York with offices at RD #2, Box 89A, Highland, NY 12528, party of the second part,

Witnesseth, that the party of the first part, in consideration of TEN ($10.00) dollars, lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs of successors and assigns of the party of the second part forever,

All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Esopus, County of Ulster and State of New York, bounded and described as follows:

Beginning at a point, said point being where the center line of Old Post Road intersects the right of way line of Route 9-W leading from Highland to Kingston, and running thence through the center line of said Old Post Road the following courses and distances:

South 75° 36' 42” East 407.73 feet to the westerly side of said highway leading from Highland to Kingston, known as route 9-W; thence running along the westerly side of said State Highway leading from Highland to Kingston known as 9-W, South 8° 25' 47" West 172.00 feet and 
South.17° 49' 07" West 218.71 feet to a comer of land formerly of Pell, now or formerly of Beatty and occupied by Barrington Service Station, at a stone wall; thence running along the westerly line of said last mentioned land along the center line of said stone wall, 
South 39° 07' 55" West 101.35 feet and 
South 36° 40' 23" West 253.79 feet to the center line of the former road connecting Route 9-W with the Old Post Road, and now said to be abandoned, thence running along the center line of said road now said to be abandoned, and still along said land formerly of Pell now or formerly of Beatty and 
South 46° 38' 03" East 100 feet and 
South. 10° 44' 43" East 122.18 feet to the westerly side of said State Highway leading from Highland to Kingston , known as Route 9-W , thence running along the westerly side of said State Highway; known as Route 9-W, along the following courses and distances:  
South 10° 57’ 40” West 209.01 feet to a center line of the Old Post Road and the point or place of beginning  

Together with a reservoir or pump house located on other ands now or formerly of Walrus, Inc. and the parties of the first part on the westerly side of Old Route 9-W, and a strip of land fifty (50) feet wide extending twenty-five (25) feet on each side of the pipe leading from said pump house to Old Route 9-W, and including the lands around said pump house within a distance fo ten (10) feet from the outside walls of the pump house, and the right to use such water as may be necessary for school purposes from the stream supplying said pump house.

Being the same premises as conveyed by Lewis F. McLaren to Eugene J. Conley, G. Gibbs Peterson and William A. Kelly, by deed dated the 26th day of September 1969, and recorded in the Office of the Clerk of Ulster County in Liber 1240 of Deeds at page 910.

Being the same premises conveyed by Black Creek Realty, Inc. to Fred J. Lafko by Deed Dated December 10, 1976, and filed in the Ulster County Clerk's Office on December 29, 1976 in Liber 1366 at page 1089.

The above cited description is based on the survey of Roy H. Pauli dated the 8th day of August 1972.

Together with the free and unmolested use of a strip of property for the right of laying at any time or times and/or from time to time if necessary, pipes for sewer discharge from the premised herein above conveyed, under, upon or over other premises of grantor herein adjoining on the east (designate in the Ulster County Treasurer's Office as Account No. 102406), most direct and feasible route to the Black Creek which runs through said premises.

Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof.

Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises,

To have and to hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.

And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatsoever, except as aforesaid.

And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.

The word "party" shall e construed as if it read "parties" whenever the sense of this indenture so requires.

In witness whereof, the party of the first part has duly executed this deed the day and year first above written.
