This Indenture made this Fourteenth day of October in the year of Our Lord One thousand and eight hundred and seventy one
Whereas at a special term of
the Supreme Court of the State of New York held at the City Hall in the
City of Albany on the thirtieth day of August One thousand eight hundred
and seventy one it was among other things ordered adjudged and decreed
by the said Court in a certain action pending in the said Court –
between the said William H Dunning, Sarah Matilda Mygatt and Angeline E
Darling as surviving executors of and Trustees under the last will and
testament of Jacob A Robertson deceased plaintiff against Robert L Pell,
Joshua Bailey and Rebecca his wife Oscar Anne a figure in bankruptcy of
Joshua Biley and others defendants that all and Singular the premises
described in a mortgage executed by Robert L Pell and Maria Louisa his
wife to Jacob A Robertson and recorded in Ulster County Clerks Office in
Liber 78 at page 299 and being the same premises mentioned in the
complaint in said action and in said judgment described in so much
thereof as might be sufficient to raise the amount due to the plaintiff
for principal and costs in said action and which might be sold
separately without material injury to the parties interested be sold at
public auction according to the course and practice of said Court by or
under the direction of the said Daniel E Keyser who as appointed a
referee in said action and to whom it was referred by the said order and
judgment of the said Court among other things to make such sale that the
said sale be made in the County where the said mortgaged premises or the
greater part thereof are situated that the said referee give public
notice of the time and place of such sale according to the course and
practice of said Court and that any of the parties in Said action might
become a purchaser on such sale that Said Referee execute to the purchaser or purchasers of the said mortgaged premises or such part or parts thereof as shall be sold a good and sufficient deed or deeds of conveyance for the same and
Now this Indenture Witnesseth
that the said Referee the party of the first part to these presents in
order to carry into effect the sale so made by him as aforesaid in
pursuance of the order and judgment of the said Court and in conformity
to the Statute in such case made and provided and also in consideration
of the premises and of the said sum of money so bidden as aforesaid
having been first duly paid by the said party of the second part—the
receipt whereof is hereby acknowledged hath bargained and sold and by
these presents doth grant and convey unto the said party of the second
part All that certain farm of land Situate in the town of Esopus and County of Ulster and known as the homestead farm of John Beaver deceased and is bounded generally as follows on the North by lands belonging to the heirs of Nicholas Murphy deceased and the factory lot on the East by lands of said Pell and Mrs. Pratt on the South by lands of Mrs. Pratt and Archibald Russell and on the west by said factory lot and lands of Cornelius Relyea. Containing about seventy one acres more or less being the same premises conveyed by James Lewwiller and wife to Joseph Graves in the year 1858 excepting and reserving therein so much of said premises as were heretofore conveyed by said Pell and wife to the Church of the Ascension for a cemetery.
