This Indenture made the second day of December in the year of our Lord one thousand seven hundred and sixty nine Between Michael Devoe of the Precinct of the New Paltz in the County of Ulster and Province of New York, Yeoman of the one part and Gabriel Carling of the same place Ship's Carpenter of the other part Witnesseth that the said Michael Devoe for and in consideration of the Sum of sixty pounds current money of New York to him in hand paid by th3e said Gabriel Carling the receipt whereof the said Michael Devoe doth hereby acknowledge, he the said Michael Devoe hath granted, bargained and sold aliened and confirmed and by these presents doth grant, bargain and sell alien and confirm unto the said Gabriel Carling his heirs and assigns forever All that just fifth part of all that undivided Tract or lot of land situate lying and being within the bounds of a certain Patent commonly called the New Paltz Patent in the County of Ulster aforesaid being part of a certain tract or lot of land known and distinguished by the Northern lot number nine. The said undivided Tract or Lot of land being bounded to the North by part of the said lot No 9 which is already divided Westerly three english Miles into the woods from Hudsons River, Southerly by lot No 8 and Easterly by Hudsons River, containing two hundred and fifty acres. Also a small lot of land lying and being within that part of the said Lot No 9 which was formerly divided Beginning in the Southerly corner thereof on Hudson's River runs thence Westerly three chains, thence Northerly one chain sixty six links and one half, thence Easterly parrallel with the first line three chains to Hudson's River, thence Southerly along the said River to the place of beginning containing one half acre. Together with all and singular the Trees, woods, underwoods, tithes, commons common of Pasture, profits, commodities, advantages, hereditaments, way, waters and appurtenances whatsoever to the said just fifth part of all that undivided tract or log of land. And also that small lot of land above described belonging or in any wise appertaining (Excepting and reserving out of the said just fifth part of that undivided Tract or lot one half acre to the said Michael Devoe his heirs and assigns forever in lieu and instead of the last above described lot And also the reversion and reversions, remainder and remainders, rents and services of the said premises and of every part thereof; And all the estate, right, title, interest, claim and demand whatsoever of him the said Michael Devoe of in and to all and singular the said premises and every part thereof (Except as before excepted.) To have and to thold the said just fifth part of all that undivided Tract or lot of land, and also the said small lot of land, and all and singular the premises above mentioned and every part and parcel thereof with the appurtenances (Except as above excepted) unto the said Gabriel Carling his heirs and assigns to the only proper use and behoof of the said Gabriel Garling his heirs and assigns forever. And the said Michael Devoe for himself and his heirs the said just fifth part of all that undivided tract or lot of land. And also that small lot of land and premises and every part thereof against him and his heirs and against all and every other person and persons whatsoever, to the said Gabriel Carling his heirs and assigns shall and will warrant and forever defend (except as before excepted). In Witness the said parties to these presents have hereunto set their hands and Seals the day and year first above written. Sealed and Delivered in the presence of Received on the day of
the date of the within contained deed of the within named Gabriel
Carling the sum of sixty pounds in full for the consideration money

Michael Devo State of New York I do certify that on
the ninth day of August in the year of our Lord one thousand eight
hundred and fourteen before me, Jacob Trumpbour Jun, one of the Judges
of the Court of Common Pleas for said County came Christopher Tappen one
of the subscribing witness to the within conveyance to me known, being
duly sworn saith that he saw Michael Devoe the grantor of the within
conveyance execute the same as his act and deed for the uses t6hereon
mentioned and know him to be the same person therein described, that
himself and Gamaliel Wallis subscribed their names as Witnesses A true record entered this 9th day of August 1814 |
