| This Indenture Made the 24th day of December in the year
one Thousand Eight hundred and Eighty Three Between Adelia Duane (sole Surviving child and heir of Maria Luisa
Brinkerhoof and her husband Robert Livingston Pell both now deceased)
and John B Ireland her husband all of the city County and state of New
York parties of the first part and Maria Jane Moore wife of Hiram Moore
both also of said city county and state of New York party of the second
part. All that certain tract or parcel of land with the Buildings and improvements thereon and Situate lying and being partly in the Town of New Paltz and partly in the town of Esopus in the County of Ulster and state of New York at the North Easterly Corner of the Town of New Paltz. Beginning in the said town of New Paltz at the south east corner of the tract which is or was known as the Polhamus lot at a hemlock tree standing on the west bank of the Hudson River distant about fifty chains southerly from the Mouth of Beaver Creek where said creek empties into the Hudson River and running thence North Seventy five degrees west thirty Seven chains and fifty links to a heap of Stones in the southwesterly corner of said tract. thence running north three degrees east four chains and twenty eight links to a pine tree marked. thence running north seventy eight degrees west three chains to a chestnut tree on the south east bank of the Beaver Creek. thence running north twenty two degrees east along the said creek three chains and sixty eight links to the end of the wall on the northwesterly corner of the said Polhamus lot. thence running north eighty one degrees west one chain and seventy links across said Beaver Creek and the road thence running north seventeen degrees east along the said road three chains and seventy three links to the corner of the nursery. thence running north sixty seven degrees west one chain and thirty links. thence running north forty seven degrees west one chain. thence running north seven and one half degrees east six chains and ninety links to the south side of the road. then running north fourteen degrees west one chain to the corner. thence running north thirteen degrees east seven chains. thence running north twelve degrees east seven chains and eighty eight links to George Townsends line as now or lately run out. thence running north eighty four and one half degrees east twenty chains and ninety links to the shore of the bay at the mouth of the said beaver creek and where the said creek empties into the Hudson River. thence continuing on the same course first mentioned eight chains and seventy seven links to a pine bush on the easterly side of the points formed by the said Bay or mouth of Beaver Creek and the Hudson River and thence running southerly along the margin of the said Hudson River to the place of beginning. And also all the land covered by water and within the boundaries aforesaid containing in the whole one hundred and forty three acres more or less together with all privileges the said Robert Livingston Pell his said wife or his said Daughter and heir may now possess of ingress & egress to said premises but subject to any and all conditions under which they may possess them and no more. Together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents issues and profits thereof and also all the estate right title interest dower and right of Dower property possession claim and demand whatsoever as well in Law as in Equity of the said part of the first part of in and to the same and every part and parcel thereof with the appurtenances. To have and to hold the above granted bargained and described premises with the appurtenances unto the said party of the second part her heirs and assigns to her and their own proper use benefit and behoof forever. And the said parties of the first part Adelia Duane & John B Ireland for their heirs Executors and Administrators do hereby covenant grant and agree to and with the said party of the second part her heirs and assigns that the said parties of the first part at the time of the sealing and delivery of these presents were lawfully seized in fee of a good absolute and indefeasible estate of inheritance in fee simple of in and all and singular the above granted and described premises with the appurtenances and have good right full power and lawful authority to grant bargain sell and convey the same in manner aforesaid and that the said party of the second part her heirs and assigns shall and may at all times hereafter peaceably and quietly have hold use occupy possess and enjoy the above granted premises and every part and parcel thereof with the appurtenances without any let suit trouble molestation eviction or disturbance of the said parties of the first part, their heirs and assigns or any other person or persons lawfully claiming or to claim the same and that the same now are free clear discharged and unencumbered of an from all former or other grants titles charges estates judgments taxes assessments and encumbrances of what nature or kind soever. And also that the said parties of the first part and their heirs and all and every person or persons whomsoever lawfully or equitably deriving any estate right title or interest of in or to the hereinbefore granted premises by from, under or in trust for them or either of them shall and will at any time or times hereafter upon the reasonable request and at the proper cost and charges in the Law of the said party of the second part her heirs and assigns make as and execute or cause to be made done and executed all and every such further and other lawful and reasonable acts conveyances and assurances in the law3 for the better and more effectually vesting and confirming the premises hereby granted or so intended to be in and to the said party of the second part her heirs and assigns forever as by the said party of the second part her heirs and assigns or her or their counsel learned in the law shall be reasonably advised or required. And the said parties of the first part for themselves and their heirs the above described and hereby granted premises with every part and parcel thereof with the appurtenances unto the said party of the second part her heirs and assigns against the said parties of the first part their heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same shall and will Warrant and by these presents forever Defend. In Witness Whereof the said parties of the
first part have hereunto set their hands and seals the day and year
first above written. On the 24th day of
December in the year one thousand eight hundred and eighty three before
me personally cmae Adelia Duane Ireland and her said husband Jno B
Ireland to me well known to be the individuals described in and who
executed the foregoing instrument and they severally acknowledged that
they executed the same for the purposes and uses therein contained and
the said Adelis Duane Ireland on a private examination by me made
separate and apart from her said husband acknowledged to me that she
executed the same of her own free will and without fear or compulsion
from her said husband. State of New

} I, Patrick Keenan clerk of the city and county of New York and also clerk of the Supreme Court for the said city and county the same being a Court of Record do hereby certify that B. W. Williams Jr whose name is Subscribed to the certificate of the proof or acknowledgment of the annexed instrument and thereon written was at the time of taking such proof and acknowledgment a Notary Public in and for the city and county of New York dwelling in the said city Commissioned and sworn and duly authorized to take the same and further that I am well acquainted with the handwriting of such Notary and Verily believe that the Signature to the said certificate or proof or acknowledgment is genuine.
