 Samuel Donaldson estate to John J. Deyo

 This Indenture made the twenty second day of March in the year of our Lord one thousand eight hundred and Seventeen

Between Daniel H Ostrom and Barnabas Benton Administrators of Samuel Donaldson deceased  and Wells Sake all of the town of New Paltz, Ulster County and State of New York of the first part and John J. Deyo of the same place of the second part   

Whereas David Brodhead Junior Esquire Surrogat e of the said County of Ulster did on th4e thirty first day of July last past make a certain order or decree in his Surrogate's Court in the words and figures following to wit

At a Surrogates Court held at the Surrogates office in the village of Kingston in the County of Ulster on the thirty first day of July in the year one thousand eight hundred and Sixteen Present Daniel Brodhead Junior Surrogate of Said County

Whereas upon the petition of Daviel H. Ostrom and Barnabas Benton Administrators and Elenor Donaldson Administratrix of all and singular the goods and Chattles & Credits of Samuel Donaldson deceased presented to the said Surrogate Setting forth among other things that the said Samuel Donaldson was at the time of his death Seized of a real estate within the said County of Ulster and that his personal estate was insufficient to pay his Debts and praying the aid of the Surrogate in the premises an order was thereupon made on the fifteenth day of Same in the year aforesaid which said order has been published for four weeks successively in two of the public newspapers printed in this County directing all persons interested in the estate of the said Samuel Donaldson to appear before the Said Surrogate at the Surrogates office in Kingston in the County of Ulster on the thirty first day of July next thereafter to show cause if any they had why so much of the real estate whereof the said Samuel Donaldson died Seized Should not be Sold as would be Sufficient to pay his Debts and now here at this day David H. Ostrom, Barnabas Benton & Elenor Donaldson Administrators & Adminstratrix aforesaid appeared before the Said Surrogate whereupon the Said Surrogate now here proceeds to hear and examine the proofs and allegations by the Said Daniel H. Ostrom Barnabas Benton & Elenor Donaldson produced and upon due examination doth find and adjudge that the personal estate of the Said Samuel Donaldson is insufficient to pay his Debts that the Said David H. Ostrom Barnabas Benton and Elenor Donaldson have applied the personal estate which hath come to their hands towards the payment of the Debts of the said Samuel Donaldson and whereas the said lands tenements hereditaments and appurtenances and circumstances that a part thereof cannot be sold without manifest prejudice to the heirs therefore the Said Surrogate Doth order and Direct pursuant to the Statute in such Case made and provided that the whole of all the right title and interest of the Said Samuel Donaldson of in & to all that Certain equal South half of all that certain farm being the Southerly part of the easterly half of lot No eleven one of the three mile or river lots in the north division of the patent of the New Paltz

Beginning at Hudsons river in the division line of said lot No 11 and lot No 10 being in the northeasterly of Jacob Whitneys lot and runs thence along the division line north seventy two degrees west One hundred and Sixteen Chains (more or less) to the southeasterly Corner of Alexander Youngs lot Sugar maple tree thence along a line of old marked trees north Seven degrees east nineteen Chains fifty links to two Stone set up together in a tamarack swamp thence South Seventy four degrees and forty minutes east one hundred and sixteen chains to Hudsons river aforesaid then down along the same as it runs about twenty four chains (more or less) to the place of beginning Containing about Two hundred and fifty acres

Also the barn and the ground under the same together with the ground on the east side of said farm as it is now fenced in for a yard and the ground south of the barn up to the division line also two feet of ground on the west and north sides of said barn excepting and reserving out of the first described premises in the Southwest Corner of the same twenty two acres Said to have been heretofore released from the same, be sold and that conveyances upon such sale or sales be thereupon executed by the said David H Ostrom Barnabas Benton and Elenor Doaldson Administrators and administratrix as aforesaid together with Wells Lake whom the said Surrogate doth hereby appoint as a discreet person to execute the said Conveyances with the said David H Ostrom, Barnabas Benton and Elenor Donaldson administrators and administratrix as aforesaid pursuant to the Statute in such case made and provided to the purchaser or purchasers thereof and the monies arising from such Sale or Sales to be brought into the office of the Surrogate of the County of Ulster the Sale to be subject to the widows right of Dower

In testimony whereof we have caused the seal of office of our Said Surrogate to be hereunto affixed   Witness Daniel Brodhead Junior Surrogate of the said County of Kingston the thirty first day of July in the year one thousand eight hundred and sixteen.

Whereas the said premises and farm of land in the said order described were in pursuance of the said order and according to the provisions and directions of the act in such case made and provided advertised for sale at public auction and were sold on the twenty second day of March in the Year one thousand and eight hundred and seventeen to the said John J Deyo for the sum of Six thousand one hundred thirty two dollars and fifty cents being the highest sum bid for the same now

Now This Indenture Witnesseth that the said parties of the first part for and in Consideration of the said Sum of Six thousand one hundred thirty two dollars and fifty Cents to 5them in hand paid by the said party of the Second part at and before the ensealing and delivery of these presents have granted bargained and sold aliened and conveyed and by these presents do grant bargain sell alien and convey unto the Said party of the Second Part in ins actual possession now being and to his heirs and assigns forever

All the said farm and premises in the above recited order Set forth and described and all the right title and inter5est of the Said Samuel Donaldson deceased in and to the same in as full land ample a manner as the parties of the first part may or can do by virtue of the said above recited order or otherwise to have and to hold the said premises with the appurtenances unto the said party of the Second part his heirs and assigns to the use of the Said Party of the Second Part his heirs and assigns forever

I do Certify that on the 19th day of November in the year of our Lord one thousand eight hundred and twenty three personally appeared before me Samuel Duncombe one of the Commissioners of the County of Ulster, Daniel H. Ostrom, Barnabas Benton and Wells Saki all of the town of New Paltz and county of Ulster, all personally known to me and all of them acknowledged that they had executed the within Deed for the purposes therein mentioned let the same be recorded
