Helen R Russell to the Church of the Ascension

This Indenture made the first day of February 1881 between Helen R Russell party of the first part and the Rector, Church Wardens and Vestry of the Church of the Ascension in Esopus party of the second part.

Whereas Archibald Russell on or about the 5th day of February 1859 purchased from Morris A Phelps a certain plot of land hereinafter described on which it was proposed to build a Rectory for the use of said party of the second part said purchase being made upon the understanding that it was for the benefit of said party of the second part and that said Archibald Russell would convey to said party of the second part the said premises on demand and

Whereas through an oversight no such conveyance was ever made and said Archibald Russell having departed this life and by his last Will and Testament dated the Sixth day of May 1871 and recorded in the office of the clerk of Ulster County did devise all of his real estate in the town of Esopus County of Ulster and state of New York to the said party of the first part and said party of the first part being now desirous of carrying out said understanding in regard to said parcel of land

Now therefore this Indenture Witnesseth that the party of the first part in consideration of the sum of one dollar to her in hand paid the receipt of which she hereby acknowledges has granted bargained and sold conveyed and confirmed and by these presents does grant bargain and sell convey and confirm unto the said party of the second part its successors and assigns 

All that plot of land conveyed to Archibald Russell by Morris A Phelps by deed dated February 5th 1859 and Recorded in the office of the clerk of Ulster County in Book of Deeds No 106 page 299 and described in said deed as follows

All that parcel of land in the Town of Esopus County of Ulster and State of New York adjoining the Episcopal Church of the Ascension in said Town and bounded upon the west by the East line of the said Church lot and the east line of a lot belonging to Thomas Robinson. On the North by the lots belonging to the heirs of James Dean deceased. On the South by the private road crossing the farm now or formerly of Norris A Phelps and on the East by a line running parallel to said line of the Church Lot and distant therefrom so as to include in the lot of ground hereby conveyed one acre of land strict measure 

Together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in anywise appertaining to have and to hold the above granted and described premises unto the said party of the second part its successors and assigns forever.

On this ninth day of February in the year one thousand eight hundred and eighty six before me personally came Henry Lewis Morris subscribing witness to the annexed conveyance with whom I am personally acquainted who being by me duly sworn said that he resided in the City of New York that he was acquainted with Helen R Russell and knew her to be the person described in and who executed the said conveyance and that he saw her execute and deliver the same and that she acknowledged to him the said Henry Lewis Morris that she executed and delivered the same and that the said Henry Lewis Morris thereupon subscribed his name as a witness thereto.

I James A Flack, Clerk of the City and County of New York and also Clerk of the Supreme Court for the said city and county the same being a Court of Record do hereby certify that Arthur Simonson has filed in the Clerk’s Office of the County of New York a certified copy of his appointment as Notary Public for the County of Kings with his autograph signature and was at the time of taking the proof or acknowledgment of the annexed instrument duly authorized to take the same and further that I am well acquainted with the handwriting of such Notary and verily believe the signature to the said Certificate of Proof or acknowledgment to be genuine. I further certify that said instrument is executed and acknowledged according to the law of the state of New York.
