This Indenture made the
fifteenth day of June in the year one thousand eight hundred and eighty
six Between Sarah Matilda Mygatt Angeline E Darling as
surviving executors of and trustees under the last will and testament of
Jacob A Robertson late of the City of New York deceased parties
of the first part and Anna T. Pratt of Esopus Ulster County New
York party of the second part
Witnesseth that the said parties of the first part for and in
consideration of the sum of three thousand dollars lawful money of the
United States of America to them in hand paid by the said party of the
second part at or before the ensealing and delivery of these presents
the receipt whereof is hereby acknowledge have granted bargained sold
aliened remised released conveyed and confirmed and by these presents do
grant bargain sell alien remise release convey and confirm unto the said
party of the second part and to her heirs and assigns forever
All that certain Farm of land situate lying and being in the Town of
Esopus Ulster County New York now in the occupation of the widow Ariel G
Beaver known as the Homestead Farm of John Beaver deceased and is
bounded generally as follows
On the North by lands belonging to the heirs of Nicholas Murphy deceased
and the Factory lot. On the east by lands now or lately of Robert L.
Pell and of Mrs. Pratt. On the South by lands now or later of Mrs. Pratt
and of Archibald Russell and on the west by said Factory lot and lands
now or late of Cornelius Relyea being the same premises conveyed by
James Cranston and wife to Joseph Beaver in the year 1858 excepting and
reserving therein so much of said premises as were heretofore conveyed
by Robert L Pell and wife to the church of the Ascension for a cemetery.
The premises hereby conveyed being the same as were conveyed to the
parties of the first part hereto and William H Dunning (now deceased) by
David E. Keyser Referee by deed bearing date the fourteenth day of
October 1871 and recorded 21st October 1871 in liber 173 of Deeds at
page 241 in Ulster County Clerks Office. Excepting and reserving
therefrom the premises heretofore conveyed to the New York West Shore
and Buffalo Railway Company.
Together with all and singular the tenements hereditaments and
appurtenances thereto belonging or in anywise appertaining and the
reversion and reversions remainder and remainders rents issues and
profits thereof and also all the estate right title interest property
possession claim and demand whatsoever as well in law as in equity of
the said parties of the first part of in or to the above described
premises and every part and parcel thereof with the appurtenances. To
Have and to Hold all and singular the above mentioned and described
premises together with the appurtenances unto the said party of the
second part her heirs and assigns forever
And the said Sarah Matilda Mygatt and Angeline E. Darling for themselves
their heirs executors and administrators do jointly and severally
covenant promise and agree to and with the said party of the second part
her heirs and assigns that they have not made done committed or executed
or suffered any act of acts thing or things whatsoever whereby or by
means whereof the above mentioned and described premises or any part of
parcel thereof now are or at any time hereafter shall or may be
impeached charged or encumbered in any manner or way whatsoever
