Eugene R Durkee to Adam Neidlinger

Between Eugene R Durkee of the town of Esopus, County of Ulster and State of New York part of the first part and Adam Neidlinger of the same town party of the second part.

Witnesseth that the said party of the first part in consideration of the sum of one dollar to him duly paid has sold and by these presents does grant and convey to the said party of the second part his heirs and assigns

All that certain part of a gravel hill lying in said Town of Esopus on the southwest side of the Hyde Park and Dashville road being bounded as follows:

Beginning at a stone set in the ground on the top of said hill and running South six degrees West one chain and seventy five links to the west side of said road therein along the west and south sides of said road about three chains and fifty links to the end of a stone wall. Thence South ten degrees East one chain and fifty-seven links to the place of beginning. Containing one tenth of an acre. Subject to the conditions that gravel shall not be removed from so close to the line as not to leave as much gravel for the use of the road as the present Survey of the road now covers and yet not undermine a fence or wall set upon said line across the gravel hill and also Subject to the reservation of the privilege of drawing a few loads reserved to Elias Terpenning if he should want to use it about his house or otherwise.

Being the same premises conveyed to Archibald Russell by Elias Terpenning by deed dated November 15, 1853 and recorded in Ulster County Clerk’s Office in Book No 94 of Deeds page 384 and the same as conveyed by Helen R. Russell widow and diviser of said Archibald Russell to Cynthia Helen Durkee by deed dated 7th December 1885 and recorded in Book No 260 of Deeds in said Clerk’s Office at page 619 and which came to the party of the first part by demise of said Cynthia Helen Durkee who was his wife and is now dead.

With the appurtenances and all the estate with and interest therein of the said party of the first part and the said party of the first part does hereby covenant and give to agree to and with the said party of the second part his heirs and assigns that the premises thus conveyed in the quiet and peaceable possession of the said party of the second part his heirs and assigns he will forever warrant and defend against any person whomsoever lawfully claiming the same or any part thereof.
