This Indenture made the twenty third day of October in the year of our Lord one thousand eight hundred and twenty seven Between John J. Cameron of the City of New York Esquire of the first part and Alfred S. Pell of the same city Esquire of the second part
Witnesseth that for and in consideration of five thousand dollars
of lawful money of the United States of America to the said John J.
Cameron in hand paid by the said Alfred S. Pell the receipt whereof is
hereby acknowledged and for divers other good causes and considerations
he the said John J Cameron for himself and his heirs hath covenanted and
granted and by these presents doth covenant and grant to and with the
said Alfred S Pell his heirs and assigns that he the said John J.
Cameron shall and will some time before the end of October Term in the
year of our Lord one thousand and eight hundred and twenty seven
acknowledge and levy in due form of law in the Supreme Court of
Indicature of the People of
the State of New York before the Justices of the said court unto the
said Alfred S. Pell, his heirs and assigns one or more fine or fines Sur
cognisance de droit come cio with
proclamations to be thereupon had according to the form of the statute
in such case made and provided of
All those certain tracts or parcels of land with the Buildings
and improvements thereon erected and made situate lying and being partly
in the town of New Paltz and partly in the town of Esopus in the County
of Ulster and State of New York and at the northeasterly corner of the
said town of New Paltz and southeasterly corner of the said town of
Esopus the first of which said tracts or parcels of land is situate on
the west side of the Hudson river and is bounded and described as
follows Beginning in the said town of New Paltz at the southeast corner of the said first tract or parcel of land and also at the southeast corner of that part of the said tract which is commonly known as the Polhamus lot at a hemlock tree standing on the west banks of the Hudson river distant about fifty chains southerly from the mouth of Beaver Creek or where the said creek empties into the Hudson river and running thence north seventy five degrees west thirty seven chains and fifty links to a heap of stones in the south westerly corner of said tract thence running north three degrees east four chains and twenty eight links to a pine tree marked thence running north seventy eight degrees west three chains to a chestnut tree on the southeast bank of Beaver Creek marked thence running north twenty two degrees east along the said Creek three chains and sixth eight links to the end of the wall in the northwesterly corner of the said Polhamus lot thence running north eighty one degrees west one chain and seventy links across said Beaver Creek and the road thence running north nineteen degrees east along the said road three chains and seventy three links to the corner of the nursery thence running north sixty seven degrees west one chain and thirty links thence running north forty seven degrees west one chain thence running north seven and a half degrees east six chains and ninety links to the south side of the road thence running north fourteen degrees west one chain to the corner thence running north thirteen degrees east seven chains thence running north twelve degrees east seven chains and eighty eight links to George Townsend’s line thence running north eighty four and a half degrees east twenty chains and ninety links to the shore of the bay at the mouth of the said Beaver Creek and where the said creek empties into the Hudson river thence continuing in the same course first mentioned eight chains and seventy seven links to a pine push on the easterly side of the point formed by the said bay or mouth of Beaver Creek and the Hudson river and thence running southerly along the margin of the Hudson river to the place of beginning.
And also all the land covered by water and included within
the boundaries aforesaid. Containing
in the whole one hundred and forty-three acres more or less. *

* * The second of which said tracts or parcels of
land is described and known by the name of Raaphos or Esopus Island
situate in the Hudson river in an easterly direction from the mouth of
the said Beaver Creek and the tract of land herein before particularly
described and contains ten acres of land more or less.
Together with all and singular the rights members and
appurtenances thereof and of every part and parcel thereof and also the
reversion and reversions remainder and remainders rents and profits of
the said premises and of every part and parcel thereof with the
appurtenancy by the name and description thereof herein above Contained
or by such other apt and fit name or named quantities and qualities of
land descriptions and particulars and other certainties and in such
manner and form as by the said Alfred S. Pell his heirs or assigns or by
his or their counsel learned in the law shall be reasonably devised or
advised and required which said fine or fines so as aforesaid or in any
other manner to be had and levied of the said premises with the
appurtenances or of any part thereof and all and every other fine or
fines assessment or
assessments recovery or recoveries conveyance and assurance in the law
whatsoever had or made or at any time hereafter to be
made, delivered, executed or suffered of the said premises with the
appurtenances or of any part thereof by or between the said parties to
these presents their heirs or assigns shall be and
ensure and shall be adjudged construed deemed and taken to be and
ensure to and for the only proper use and behoof of the said Alfred S.
Pell his heirs and assigns forever and to and for no other use intent or
purpose whatsoever.
And this Indenture further witnesseth that the said John J
Cameron for himself and his heirs hath covenanted and granted and hereby
doth covenant and grant to and with the said Alfred S. Pell his heirs
and assigns that he the said John J Cameron and his heirs shall and will
at any time after the levying and acknowledging of the aforesaid fine or
fines at the reasonable request and at the costs and charges of the said
Alfred S. Pell his heirs or assigns make and execute all such deed and
deeds frossment and frossment conveyance and assurance in the law as
well for declaring the uses of the said fine or fines to be such as the
said Alfred S. Pell his heirs or assigns shall or may direct as for the
better or more full and certain assurance of the said premises and every
part thereof with their and every of these appurtenances to the said
Alfred S. Pell his heirs or assigns as by the said Alfred S. Pell his
heirs or assigns or by his or their counsel learned in the law shall or
may be reasonably advised devised or required In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year first above written. Sealed and delivered in the presence of
