| THIS INDENTURE, Made the 14th
day of July, Nineteen Hundred and thirty BETWEEN HARRY PAYNE BINGHAM and
GRACE M. BINGHAM, his wife, of No. 12 East 73rd Street, New York, N. Y.,
parties of the first part, and the COUNTY OF ULSTER, a municipal
corporation, being one of the counties of the State of New York, party
of the second part
WITNESSETH, that the parties of the first part, in consideration of FIVE THOUSAND FIVE HUNDRED Dollars ($5,500) lawful money of the Unites States, paid by the party of the second part, do hereby grant and release unto the party of the second part, its successors and assigns forever, ALL THOSE PIECES OR PARCELS OF LAND hereinafter designated as Parcels A & B, situate in the Town of Esopus, County of Ulster, State of New York, for the Old Post Part 4 State Highway 5508, as shown on the accompanying map No. 29 (A - B) and described as follows: PARCEL A: Beginning at a point on the division line between the lands of A. DeKaska James Estate, reputed owner on the north, and the lands of H. P. Bingham, reputed owner on the south, said point being 34 ± feet distant westerly, measured at right angles, from station H382+13± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence easterly along said division line 127± feet to a point on the division line between the lands of H. P. Bingham, reputed owner on the northwest, and the lands of R. A. Beatty, reputed owner on the southeast, the last mentioned point being 90 feet distant easterly, measured at right angles from station H382+32± of the said base line; thence southwesterly along said division line 405± feet to a point 43 feet distant northwesterly, measured at right angles, from station H386+19 of said base line rear tangent produced forward, thence N 15º 58' E, 221.0 ± to a point 34 feet distant westerly, measured at right angles, from station H383+85 of said base line; thence N 6º 35' E, 172.0± feet to the point of beginning, being 0.599 acres more or less. PARCEL B: Beginning at a point on the division line between the lands of H. P. Bingham, reputed owner on the west, and the lands of R. A. Beatty, reputed owner on the east, said point being 65 ± feet distant northwesterly, measured at right angles, from station H391+05± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence southerly along said division line 233 ± feet to its intersection with the northeasterly boundary of the existing Old Post Highway, the last mentioned point being 21± feet distant easterly, measured at right angles from station H393+15± of the said base line; thence northwesterly along the said boundary 86± feet to a point 40 feet distant westerly, measured at right angles, from station H392+55± of the said base line; thence N 10º 32' E, 159.7 feet to the point of beginning; being 0.112 acres more or less. The above mentioned survey base line is a portion of the survey base line for the said proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County, and is described as follows: Beginning at station H381+39, thence S 6º 35' W, 371 feet to station H385+10, thence S 21º 56' W, 99 feet to station H 386+09, thence S 3º 26' W, 324 feet to station H389+33, thence S 23º 11' W, 232 feet to station H 391+65, thence S 15º 55" W, 169.8 feet to station H393+34.8, which equals station R394+60 main line. ALSO ALL THOSE PIECES OR PARCELS OF LAND hereinafter designated as Parcels A, B & C, situate in the Town of Esopus, County of Ulster, State of New York, for the old Post Part 4 State Highway 5508, as shown on the accompanying map No. 31 A-B-C (r-2) and described as follows: PARCEL A: Beginning at a point on the westerly boundary of the existing Old Post Highway, said point being 27 ± feet distant westerly, measured at right angles, from station R395+53 ± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence S 5º 15' W, 875.2± feet to a point 35 feet distant westerly, measured at right angles, from station R404+30 of said base line; thence S 1º 10' W, 42.0± feet to a point on the division line between the lands of H. P. Bingham, reputed owner on the north, and the lands of Ascension Cemetery Association, reputed owner on the south, the last mentioned point being 34 feet distant westerly, measured at right angles, from station R404+72± of the said base line; thence along said division line 16± feet to its intersection with the westerly boundary of said existing highway, the last mentioned point being 18± feet distant westerly, measured at right angles, from station R404+76± of the said base line; thence northerly along the last mentioned boundary of said existing highway 922± feet to the point of beginning; being 0.310 acres more or less. PARCEL B: Beginning at a point on the westerly boundary of the existing Old Post Highway at the intersection of the said boundary with the division line between the lands of Ascension Cemetery Association, reputed owner on the north, and the lands of H. P. Bingham, reputed owner on the south, said point being 11± feet distant westerly, measured at right angles from station R406+84± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence westerly along said division line 19± feet to a point 30 feet distant westerly, measured at right angles, from station R406+84± of said base line; thence S 1º 44'W, 216.0± feet to a point 27 feet distant westerly, measured at right angles, from station R409+00 of said base line; thence S 4º 08' W, 500.2 feet to a point 41 feet distant westerly, measured at righ5t angles, from station R414+00 of said base line;, thence S 6º 33' E, 151.9± feet to a point on the westerly boundary of said existing highway, the last mentioned point being 17 feet distant westerly, measured at right angles, from station R415+50± of the said base line; thence northerly along the last mentioned boundary of said existing highway 866± feet to the point of beginning; being 0.413 acres more or less. PARCEL C: Beginning at a point on the easterly boundary of the existing Old Post Highway, said point being 18 ± feet distant easterly, measured at right angles, from station R414+70± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence S 10º 31' E, 264.6± feet to a point on the easterly boundary of said existing highway, the last mentioned point being 20 feet distant northeasterly, measured at right angles, from station R417+50± of said base line; thence northerly along the last mentioned boundary of said existing highway 269± feet to the point of beginning; being 0.071 acres more or less. The above mentioned survey base line is a portion of the survey base line for the said proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; and is described as follows: Beginning at station R394+60, thence S 0° 46' E, 290 feet to station R397+50, thence S 6° 34" W, 650 feet to station R404+00, thence S 2° 32' W, 1200 feet to station R416+00, thence S 21° 11"E, 1150 feet to station R427+50. TOGETHER with all the appurtenances and all the estate and rights of the parties of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, its successors and assigns forever. AND said HARRY PAYNE BINGHAM does hereby covenant as follows; FIRST,
that said HARRY PAYNE BINGHAM is seized of said premises in fee simple,
and has good right to convey the same; |
