THIS INDENTURE made the 27th day of October, Nineteen Hundred and thirty, between THE POUGHKEEPSIE SAVINGS BANK, party of the first part, and R. A. BEATTY, of the Town of Esopus, County of Ulster, State of New York, party of the second part WHEREAS John B. Ireland and Adelia Duane Ireland, his wife, by indenture of Mortgage, bearing date the 10th day of May, Eighteen hundred and ninety-eight, recorded in the office of the Clerk of the County of Ulster, in Liber 240 of Mortgages page 509, on the 18th day of May, 1898, for the consideration therein mentioned and to secure the payment of the money therein specified, did conveyed certain lands and tenements of which the lands hereinafter described are part, unto MARY OAKLEY and SARAH OAKLEY; which said mortgage was duly assigned to the Poughkeepsie Savings bank by assignment record3ed in the Ulster County Clerk's Office on April 23, 1923, in Liber 348 at page 4; AND WHEREAS the party of the first part, at the request of the party of the second part, has agreed to give up and surrender the lands hereinafter described unto the party of the second part, and to hold and retain the residue of the mortgaged lands as security for the money remaining due on said mortgage. NOW THIS INDENTURE WITNESSETH, That the party of the first part, in pursuance of said agreement and in consideration of One Dollars, ($1.00), lawful money of the United States, paid by the party of the second part, does hereby grant, release, and quitclaim unto the party of the second part, all that part of said mortgaged lands described as follows: ALL THAT PIECE OR PARCEL OF LAND, situate in the town of Esopus, County of Ulster, State of New York, for the Old Post Part 4 State Highway 5508, as shown on the accompanying map and described as follows: BEGINNING at a point on the division line between thelands of H. P. Bingham, reputed owner on the northeast, and the lands of R. A. Beatty, reputed owner on the southeast, said point being 40 feet more or less distant easterly, measured at right angles, from station H383 plus 87 more or less of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence southwesterly along said division line 242 feet more or less to a point 43 feet distant northwesterly, measured at right angles, from Station 386 plus 19 more or less of said base line rear tangent produced forward, thence south 15º 49' West 125.9 feet more or less to a point 71 feet distant westerly, measured at right angles, from Station H387 plus 38 of said base line; thence south 11º 24' west 346.3 feet more or less to a point on the division line etween the lands of H. P. Bingham, reputed owner on the west, and the lands of R. A. Beatty, reputed owner on the east, the last mentioned point being 65 feet distant northwesterly, measured at right angles, from Station H391 plus 05 more or less of the said base line; thence along said division line 233 feet more or less to its intersection with the southwesterly boundary of said existing highway, the last mentioned point being 21 feet more or less distant easterly measured at right angles from Station H393 plus 15 more or less of the said base line; thence southeasterly and southerly along the said boundary 69 feet more or less to a point on the division line between the lands of R. A. Beatty, reputed owner on the north, and the lands of H. P. Bingham, reputed owner on the south, the last mentioned point being 36 feet distant easterly, measured at right angles from StationH395 plus 10 of said base line; thence easterly along said division line 6 feet more or less to a point 42 feet distant easterly measured at right angles from Station R395 plus 11 of said base line; thence north 6º 59' east 258.5 feet more or less to a point 12 feet northeasterly, measured at right angles from Station H391 plus 18 of said base lint; thence north 13º 41' east 724.6 feet more or less to the point of beginning; being 1.366 acres more or less. TOGETHER with the hereditaments and appurtenances thereunto belonging; and all the right, title and interest of the party of the first part, of, in and to the same, to the intent that the lands hereby conveyed may be discharged from said mortgage, and that the rest of the land in the said mortgage specified may remain to the party of the first part as heretofore. TO HAVE AND TO HOLD the lands and premises hereby released and conveyed to the party of the second part, his heirs and assigns, to them, and their own proper use, benefit and behoof forever, free , clear, and discharged of and from all lien and claim under and by virtue of the Indenture of Mortgage aforesaid. IN WITNESS WHEREOF, The party of the first part has caused its corporate seal to be hereunto affixed and these presents to be signed by its duly authorized officer the day and year first above written. Gardner tome personally known who, being by me duly sworn did depose and
say that he resides in the City of Poughkeepsie, that he is the
President of the Poughkeepsie Savings Bank, the corporation described in
and which executed the above instrument: that he knows the seal of said
corporation; that the seal affixed to said instrument is such corporate
seal; that it was so affixed by order of the Board of Trustees of said
Corporation, and that he signed his name thereto by like order. STATE OF NEW YORK : I, J. A. DAUGHTON, Clerk of the County of Dutchess, and of the County Courts of said County, and of the Supreme Court of the State of New York, in and for said County, the same being Courts of Record, DO HEREBY CERTIFY : That; H. E. WEEKS whose name is subscribed to the certificate of the proof or acknowledgment of the annexed Instrument, and thereon written, was at the time of taking such proof or acknowledgment a Notary Public in and for the County of Dutchess, dwelling in the said County, commissioned and sworn and duly authorized by the law of said State to take the acknowledgments and proofs of deeds or conveyances for lands, tenements or hereditaments in said State. AND FURTHER: That I am well acquainted with the handwriting of such Notary Public and verily believe that the signature to the said Certificate of Proof or Acknowledgment is genuint.
