| THIS INDENTURE made the
6th ay of April nineteen hundred and thirty-three between HARRY PAYNE
BINGHAM and GRACE M. BINGHAM, his wife, residing at 690 Park Avenue,
Borough of Manhattan, City, County and State of New York, parties of the
first part, and the NEW YORK PROTESTANT EPISCOPAL CITY MISSION SOCIETY,
a corporation incorporated April 9, 1833, pursuant to chapter one
hundred and twenty-one of the laws of eighteen hundred and thirty-three
of the State of New York, of 30 Bleecker Street, New York City, party of
the the second part,
WITNESSETH that the parties of the first part do hereby give, grant and release unto the parry of the second part, its successors and assigns forever: ALL THAT CERTAIN TRACT OF LAND, with the buildings thereon erected, situate lying and being at Esopus, Ulster County, in the State of New York, being a portion of lot No. Eleven of the three mile or river lots, in the north division of the patent of New Paltz, lying and situate in the Township of Esopus, County of Ulster, State of New York, and which said tract of land is bounded and contains as follows: Beginning
on the Hudson River at a Pitch Pine tree on the division line between
lots numbers Eleven and twelve (11 and 12) in said patent thence running
along said division line North Seventy four (74) degrees West forty two
chains sixty eight (68) links to the center of the public highway
leading from Newburgh to Kingston. Thence [2] along said highway South
four (4) degrees East thirteen (13) chains more or less to the entrance
gate thence [3] still along said highway south twenty seven (27) degrees
East thirteen (13) chains and fifty five (55) links more or less to the
south line of the said tract thence [4] along said line as the fence now
stands south seventy two (72) degrees East thirty one (31) chains and
thirty (30) links to the Hudson River thence [5] along said River in a
Northerly direction about twenty four (24) chains to the place of
beginning. Containing as surveyed by Mark W. Powell in December 1851
eighty (80) acres and six tenths (6/10) of an acre be the said several
dimensions or contents more or less. AND ALSO ALL the right, title and interest, estate and advantages which the said Alexander Holland and wife have acquired and now have or might hereafter have by virtue of a certain Act of the Legislature of the State of New York, entitled "An Act to Authorize Archibald Russell to erect a dock or whart in the Hudson River, In the Town of Esopus, adjoining his lands", passed May 14, 1845. AND ALSO ALL THAT CERTAIN TRACT, PIECE OR PARCEL OF LAND, situate, lying and being in the Town of Esopus, County of Ulster and State of New York, bounded and described as follows: Beginning
at a point in the highway leading from Newburgh to Kingston where the
division line between lot Eleven(11) and lot twelve (12) of the three
mile or River lots in the North division of New Paltz crosses said
highway at or near the southerly boundary of a cemetery running thence
along said line North seventy-one (71°) degrees thirty ( 30’) minutes
West six thousand five hundred and eighty nine (6589) feet more or less
thence South (41°) forty-0ne West six hundred and sixty four (664) feet
more or less thence South 17° 15’ West seven hundred and fifty two
(752) feet to the highway known as the West Park road thence in a
Southeasterly direction along said Highway as it winds and turns to a
stake and stones being the corner of the land now or late of M. W.
Powell thence North 13 ¾ ° East four hundred (400) feet thence North
12° four hundred (400) feet thence North 5½ ° East two hundred (200)
feet thence North 14° 30’ East two hundred and thirty (230)
feet thence South 69°30’ East nineteen hundred and fifteen (1915)
feet to the end of a stone wall thence South 70°10’ East three
thousand seven hundred and twenty (3720) feet to said highway leading
from Newburgh to Kingston and thence Northerly along said highway as it
winds and turns Seventeen hundred and fifty three (1753) feet to the
point or place of beginning Excepting
therefrom the lands conveyed by Helen R Russell to the New York West
shore and Buffalo Railway Company by deed dated November 16, 1881 and
recorded in the office of the Clerk of Ulster County in Book of Deeds
Number 232 at page 160 containing after deducting the lands of said
Railway Company two hundred and sixteen 19/100 acres be the same more or
less Being the tract or parcel of land thirdly described in and conveyed by a certain deed bearing date the 7th day of December, in the year one thousand eight hundred eighty-five, made and executed by Helen R. Russell to Cynthia Helen Durkee, the wife of Eugene R. Durkee, and recorded in the office of the Clerk of the County of Ulster on the 8th day of December, in the year one thousand eight hundred and eighty-five, in Book 260 of Deeds, at page 612, and a part of the real estate of which the said Cynthia Helen Durkee dies seized, and which by her last will and testament, bearing date May 2, 1874, and duly proved and admitted to probate in and by the Surrogate's Court of the County of Ulster on the 10th day of June, in the year one thousand eight hundred and ninety, was by her devised to her husband, the said Eugene R. Durkee. It being understood that the courses given in the foregoing descriptions are taken from surveys done by A. Grant Childs, November 1885. And all right title and interest of the party hereto of the first part to one half in width of the roads or highways lying opposite and adjacent to said premises. Being the same premises conveyed to said Adam Neidlinger by Eugene R. Durkee by deed of August 13, 1890, and recorded in the Clerk's office of Ulster County, on the 18th day of August, 1890, in Book 293 of Deeds, page 629. AND ALSO ALL THAT CERTAIN point of a gravel hill lying in said town of Esopus, on the southwest side of the Hyde Park and Dashville Road, being bounded as follows: Beginning
at a stone set in the ground on the top of said hill and running
South six degrees west one chain and seventy five (75) links to the west
side of said road thence along the west and south sides of said road
about three chains and fifty (50) links to the end of a stone wall
thence South ten degrees East one chain and fifty seven (57) links to
the place of beginning containing one tenth of an acre. Ssubject to the
condition that gravel shall not be removed from so close to the line as
to not leave as much gravel for the use of the road as the present
survey of the road now covers and yet not undermine a fence or wall set
upon said line across the gravel hill. And also subject to the
reservation of the privilege of drawing a few loads reserved to Elias
Terpenning if he should want to use it about his house or otherwise. The three last described parcels being the same premises conveyed to Oliver H. Payne by Williamson W. Fuller and wife by deed dated January 5th, 1909, and recorded on the 27th day of September 1909 in Ulster County Clerk's office in Liber 420 of Deeds at page 376. ALSO ALL THAT CERTAIN TRACT OR PARCEL OF LAND, situate in the town of Esopus, Ulster County, New York beginning
at a point on the westerly side of the Hudson River, at the
northeasterly corner of land now owned by 0. H. Payne (by deed of W. W.
Fuller dated January 5. 1909) and running from thence by survey of May,
1909. north 70 degrees 37 minutes west 2823 5/10 feet to a point in the
center of the highway leading from West Park to Esopus, thence north 50
minutes west along the center of said highway, 282 feet to a point,
thence north 83 degrees 10 minutes west passing along the northerly side
of a cemetery, 381 feet to the northwesterly corner of said cemetery,
thence south 23 degrees 40 minutes west 104 feet, thence south 17
degrees 50 minutes west 68 feet, thence south 1 degree 35 minutes west
24 feet to a point in the westerly line of said cemetery, thence north
71 degrees west crossing Black Creek. and the N. Y. S. & B. Railway;
and continuing along the northerly line of said Payne's (formerly
Fuller's) land 1307 feet to a stone heap by a wall, thence north 2
degrees 20 minutes east along the edge of the timber, 750 feet to an old
stone heap; thence south 83 degrees 57 minutes east along a row of
marked trees 617 feet to an old stone, monument, thence north 13 degrees
25 minutes east along a row of marked trees, 484 feet. to a stake and
stones at the southwesterly corner of what is termed the eight acre
factory lot; thence south 69 degrees 45 minutes east crossing the above
mentioned railway 375 5/10 feet to a point; thence north 5 degrees west
along what was originally the Saw Mill pond 81 5/10 feet to a point,
thence north 24 degrees 10 minutes east 52 2/10 feet to a point, thence
north 47 degrees 15 minutes east 39 5/10 feet to a point, thence north
72 degrees 15 minutes east continuing along the outline of the old saw
mill pond and crossing the creek, 149 feet to a point in the center of
the above mentioned highway, thence north 17 degrees 15 minutes west 241
5/10 feet to a point; thence north 2. degrees west 100 feet to a point
in the center of the highway; thence north 11 degrees east 100 feet, to
a point in the center of tie highway. thence south 84 degrees 55 minutes
east leaving the highway and passing along the southerly side of another
cemetery 90 feet to the southeasterly corner thereof, thence north 8
degrees 10 minutes east along the easterly side of the last mentioned
cemetery, 117 feet to a point in the easterly line thereof; thence south
76 degrees 10 minutes east along the southerly line of lands formerly of
A. D. James, 85 feet to a point; thence south 80 degrees 10 minutes east
187 feet to a point, thence south 78 degrees 40 minutes east 229 feet to
a point, thence south 74 degrees 50 minutes east 89 feet to a point, the
southeasterly corner of said James' lands; thence along the east line of
said James land north 20 degrees 35 minutes east 319 feet, to the south
line of lands of Robert Beatty, thence along the lands of said Beatty
the following courses and distances south 42 degrees 15 minutes east 66
feet, south 62 degrees,15 minutes east 89 foot to a corner, south 23
degrees 45 minutes west 254 feet to a corner, south 76 degrees 15
minutes east crossing a creek, 112 feet to a corner, south 26 degrees 45
minutes west on the east side of said creek. 284 feet to a corner south
73 degrees 15 minutes east 197 feet to a corner, south 7 degrees 45
minutes west 283 feet to a corner. south 70 degrees east 2514 foot to
the Hudson River, thence southerly along the west side of said river
1822 feet to the place of beginning. AND ALSO ALL the right title and interest of the parties of the first part hereto in and to any and all other lands, if any, with the buildings thereon erected, situate, lying and being in Ulster County, State of New York; and also all the right, title and interest, if any, of the parties of the first part hereto in and to the land under the Hudson River and adjacent to the lands hereinabove described. EXCEPTING from all the lands hereinabove described the following described parcels of land conveyed by Oliver H. Payne to the County of Ulster for highway usage, by deed dated December 17, 1915, recorded in Ulster County Clerk's office December 20, 1915 in Book of Deeds No. 455 page 219, and therein bounded and described as follows: ALL THOSE PIECES OR PARCELS OF LAND hereinafter designated as parcels "A" and "B", situate in the Town of Esopus, County of Ulster, State of New York, for the Old Post Road State Highway No. 5508 as shown on the accompanying map and described as follows: - PARCEL "A" Beginning at a point on the Western boundary of the Existing Old Post Road Highway, said point being 20 feet distant westerly, measured at right angles, from Station 386 + 00 of the hereinafter described survey base line of the proposed Old Post Road State Highway No. 5508, Route No. 3, Ulster County; thence south 11 degrees 14 minutes east 209.3 feet, to a point 51 feet distant southwesterly, measured at right angles, from Station 388 + 05 of said base line; thence south 32 degrees 0 minutes east 155.5 feet to a point 18 feet distant southwesterly, measured at right angles, from Station 389 + 57 "A" of said base line; thence south 56 degrees 19 minutes we3st 19.7 feet to a point 35 feet distant southwesterly, measured at right angles, from Station 389 + 62 "A" of said base line; thence south 32 degrees 09 minutes east 267.1 feet to a point 20 feet distant southwesterly, measured at right angles, from Station 392 + 23 "A" of said base line; thence north 58 degrees 51 minutes east 20.2 feet to a point on the said base line at Station 392 + 26; thence south 27 degrees 37 minutes east 175.8 feet to a point 15 feet distant northeasterly, measured at right angles, from Station 394 + 00 "A" of said base line, thence curving to the right with a radius of 395 feet a distance of 205 ± feet to a point 13 feet distant southwesterly, measured at right angles, from station 397 + 17 of said base line, thence south 3 degrees 03 minutes west 180.0 feet to a point 25 feet distant westerly, measured at right angles, from Station 399 + 00 of said base line; thence south 1 degree 43 minutes east 100.5 feet to a point on the Western boundary of said existing highway, the last mentioned point being 15 feet distant westerly, measured at right angles, from Station 400 + 00 of said base line; thence northerly along the last mentioned boundary of said existing highway 475 ± feet to a point 78 feet distant northeasterly, measured at right angles, from Station 394 + 30 "A" of said base line; thence north 32 degrees 09 minutes west 505 ± feet to a point on the southern boundary of said existing highway, the last mentioned point being 36 feet distant easterly, measured at right angles, from Station 398 + 18 "A" of said base line; thence westerly and northerly along the last mentioned boundary of said existing highway 347 ± feet to the point of beginning; being 1.12 acres more or less. PARCEL "B" Beginning at a point on the Western boundary of the existing Old Post Road Highway, said point being 32 feet distant easterly, measured at right angles, from Station 397 + 23 of the hereinafter described survey base line of the proposed Old Post Road State Highway No. 5508, Route No. 3, Ulster County; thence south 5 degrees 41 minutes east 83.2 feet to a point 32 feet distant easterly, measured at right angles, from Station 398 + 00 of said base line; thence south 8 degrees 48 minutes west 107.4 ± feet to a point on the Eastern boundary of said existing highway, the last mentioned point being 23 feet distant easterly, measured at right angles from Station 399 - 07 of said base line; thence northerly along the last mentioned boundary of said existing highway 189 ± feet to the point of beginning: being .02 acre more or less. The above mentioned survey line is a portion of the survey base line of the said proposed Old Post Road State Highway Route No. 3, Ulster County as shown on a map on file in the office of the Clerk of Ulster County, and is described as follows: - Beginning at Station 386 + 00; thence south 19 degrees 45 minutes east 270 feet to station 388 + 70; thence south 18 degrees 57 minutes east 225 feet to Station 390 + 95 "A" thence south 39 degrees 41 minutes east 136 feet to Station 392 + 31 "A"; thence south 22 degrees 04 minutes east 359 feet to station 395 + 90 side line - 397 + 00 main line; thence south 7 degrees 00 minutes east 100 feet to station 398 + 00; thence south 4 degrees 00 minutes west 200 feet to station 400 + 00; all of which is shown on map above. AND ALSO EXCEPTING THEREFROM the following described parcels of land conveyed by the parties of the first part to the County of Ulster for highway purposes, by deed dated July 15, 1930, and therein bounded and described as follows: ALL THOSE PIECES OR PARCELS OF LAND hereinafter designated as Parcels A & B, situate in the Town of Esopus, County of Ulster, State of New York, for the Old Post Part 4 State Highway 5508, as shown on the accompanying map No. 29 (A - B) and described as follows: PARCEL A: Beginning at a point on the division line between the lands of A. DeKaska James Estate, reputed owner on the north, and the lands of H. P. Bingham, reputed owner on the south, said point being 34 ± feet distant westerly, measured at right angles, from station H382+13± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence easterly along said division line 127± feet to a point on the division line between the lands of H. P. Bingham, reputed owner on the northwest, and the lands of R. A. Beatty, reputed owner on the southeast, the last mentioned point being 90 feet distant easterly, measured at right angles from station H382+32± of the said base line; thence southwesterly along said division line 405± feet to a point 43 feet distant northwesterly, measured at right angles, from station H386+19 of said base line rear tangent produced forward, thence N 15º 58' E, 221.0 ± to a point 34 feet distant westerly, measured at right angles, from station H383+85 of said base line; thence N 6º 35' E, 172.0± feet to the point of beginning, being 0.599 acres more or less. PARCEL B: Beginning at a point on the division line between the lands of H. P. Bingham, reputed owner on the west, and the lands of R. A. Beatty, reputed owner on the east, said point being 65 ± feet distant northwesterly, measured at right angles, from station H391+05± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence southerly along said division line 233 ± feet to its intersection with the northeasterly boundary of the existing Old Post Highway, the last mentioned point being 21± feet distant easterly, measured at right angles from station H393+15± of the said base line; thence northwesterly along the said boundary 86± feet to a point 40 feet distant westerly, measured at right angles, from station H392+55± of the said base line; thence N 10º 32' E, 159.7 feet to the point of beginning; being 0.112 acres more or less. The above mentioned survey base line is a portion of the survey base line for the said proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County, and is described as follows: Beginning at station H381+39, thence S 6º 35' W, 371 feet to station H385+10, thence S 21º 56' W, 99 feet to station H 386+09, thence S 3º 26' W, 324 feet to station H389+33, thence S 23º 11' W, 232 feet to station H 391+65, thence S 15º 55" W, 169.8 feet to station H393+34.8, which equals station R394+60 main line. ALSO ALL THOSE PIECES OR PARCELS OF LAND hereinafter designated as Parcels A, B & C, situate in the Town of Esopus, County of Ulster, State of New York, for the old Post Part 4 State Highway 5508, as shown on the accompanying map No. 31 A-B-C (r-2) and described as follows: PARCEL A: Beginning at a point on the westerly boundary of the existing Old Post Highway, said point being 27 ± feet distant westerly, measured at right angles, from station R395+53 ± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence S 5º 15' W, 875.2± feet to a point 35 feet distant westerly, measured at right angles, from station R404+30 of said base line; thence S 1º 10' W, 42.0± feet to a point on the division line between the lands of H. P. Bingham, reputed owner on the north, and the lands of Ascension Cemetery Association, reputed owner on the south, the last mentioned point being 34 feet distant westerly, measured at right angles, from station R404+72± of the said base line; thence along said division line 16± feet to its intersection with the westerly boundary of said existing highway, the last mentioned point being 18± feet distant westerly, measured at right angles, from station R404+76± of the said base line; thence northerly along the last mentioned boundary of said existing highway 922± feet to the point of beginning; being 0.310 acres more or less. PARCEL B: Beginning at a point on the westerly boundary of the existing Old Post Highway at the intersection of the said boundary with the division line between the lands of Ascension Cemetery Association, reputed owner on the north, and the lands of H. P. Bingham, reputed owner on the south, said point being 11± feet distant westerly, measured at right angles from station R406+84± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence westerly along said division line 19± feet to a point 30 feet distant westerly, measured at right angles, from station R406+84± of said base line; thence S 1º 44'W, 216.0± feet to a point 27 feet distant westerly, measured at right angles, from station R409+00 of said base line; thence S 4º 08' W, 500.2 feet to a point 41 feet distant westerly, measured at righ5t angles, from station R414+00 of said base line;, thence S 6º 33' E, 151.9± feet to a point on the westerly boundary of said existing highway, the last mentioned point being 17 feet distant westerly, measured at right angles, from station R415+50± of the said base line; thence northerly along the last mentioned boundary of said existing highway 866± feet to the point of beginning; being 0.413 acres more or less. PARCEL C: Beginning at a point on the easterly boundary of the existing Old Post Highway, said point being 18 ± feet distant easterly, measured at right angles, from station R414+70± of the hereinafter described survey base line of the proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; thence S 10º 31' E, 264.6± feet to a point on the easterly boundary of said existing highway, the last mentioned point being 20 feet distant northeasterly, measured at right angles, from station R417+50± of said base line; thence northerly along the last mentioned boundary of said existing highway 269± feet to the point of beginning; being 0.071 acres more or less. The above mentioned survey base line is a portion of the survey base line for the said proposed reconstruction of the Old Post Part 4 State Highway 5508, Ulster County; and is described as follows: Beginning at station R394+60, thence S 0° 46' E, 290 feet to station R397+50, thence S 6° 34" W, 650 feet to station R404+00, thence S 2° 32' W, 1200 feet to station R416+00, thence S 21° 11"E, 1150 feet to station R427+50. TOGETHER with the appurtenances and all the estate and rights of the parties of the first part in and to said premises. THE ABOVE GRANTED PREMISES ARE GRANTED, HOWEVER, SUBJECT TO THE FOLLOWING: 1)
Any state of facts an accurate survey would show. TO HAVE AND TO HOLD the above granted premises, subject as aforesaid, unto the party of the second part, its successors and assigns forever.
