This Indenture made the 14th day of April, 1941 Between the Rector, Wardens and Vestrymen of the Church of the Ascension of West Park, Town of Esopus, Ulster County, New York, party of the first part, and New York Protestant Episcopal City Mission Society, of 38 Bleecker Street, in the Borough of Manhattan, City of New York, party of the second part. Whereas, by petition verified on the 17th day of March, 1941, application was made on the 31st day of March, 1941, before Mr. Justice Bergan at a Special Term of the Supreme Court of the State of New York held in and for the County of Ulster, at the County Court House of Kingston, New York; the said party of the first part requested leave and authorization to sell and convey the fee of the premises hereinafter described, and Whereas, by order made and entered by Mr Justice Bergan on the 31st day of March, 1941, upon said application said party of the first part was authorized to sell and convey and deliver a good and sufficient deed for said premises to the New York Protestant Episcopal City Mission Society of 38 Bleecker Street, in the Borough of Manhattan, City of New York, in consideration of a transfer to it of certain real property now owned by the said New York Protestant Episcopal Mission Society more particularly described in Paragraph 5 of the petition of the party of the first part, duly filed in the Ulster County Clerk's Office.. Now, therefore, this Indenture witnesseth, that the party of the first part, for and in consideration as hereinabove set forth, does hereby convey, release, grant, bargain and sell to the said party of the second part, its successors and assigns forever, the following described premises: All that certain lot, piece or parcel of land, situate, lying and being at West Park, in the Town of Esopus, Ulster County, New York bounded and described as follows: Beginning at a corner of stone walls being the Northwest corner of the present cemetery ands of Ascension Church cemetery and running thence along an old stone wall South 24º West 96 feed to a bend in said wall; thence continuing along said stone wall South 17º 50' West 116 feet to a corner of stone walls; thence South 81º 15' East along stone wall 33 feet to a monument; thence through said cemetery lands north 11º east 207 feet to the point and place of beginning, containing 0.1 acres of land, which premises are those authorized to be sold and conveyed in the order herein described. To have and to hold said premises with the appurtenances unto said New York Protestant Episcopal City Mission Society and its successors and assigns forever. In witness whereof, the party of the first part has caused these presents to be signed by its duly authorized officer and its seal to be affixed on the date above written. (corp.

Theodor Oxholm (L.S.) STATE OF NEW YORK On this 24th day of
April, 1941, before me personally came Theodor Oxholm, to me known, who
being by me duly sworn, did depose and say that he resides at Esopus, in
the Town of Esopus, Ulster County. New York; that he is the Treasurer of
The Rector, Wardens and Vestrymen of the Church of the Ascension at West
Park, the corporation described in and which executed the above
instrument; that he knows the seal of said corporation and that the seal
affixed to said instrument is such corporate seal and that it was so
affixed by order of the Vestry of said corporation and that he signed
his name thereto by like order.. A true record entered |
