Clark Beaver to Robert L Pell |
| This indenture made the
eleventh eighth day of July, one thousand eight hundred and forty four,
between Clark Beaver of the Town of Esopus, in the County of
Ulster, and the state of New York , of the first part, and
and Robert L. Pell same place, party of the second part.
Witnesseth that the said party of the first part for and in consideration of the sum of five dollars lawful money of the United States of America, to him in hand paid by the said party of the second part at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, has remised, released and quitclaimed, and by these presents does remise, release and quitclaim unto the aid party of the second part and to his heirs and assigns forever All that certain lot, piece or parcel of land, situate lying and being in the Town of Esopus aforesaid, bounded and described as follows, Beginning at a stake set in the ground for the corner of Pellville farm and is also a corner of land owned by Joshua W Beaver, and running from thence along lands owned by Martin G Beaver, according to a survey thereof made by George Van Vliet, south fifteen degrees and fifteen minutes west seven chains to a stake and monument of stones, thence south twenty eight degrees and forty five minutes west nine chains and forth links to a point in the center of the public highway leading from the ferry at Hyde Park to the Ferry at Rondout thence along the center of said highway as follows, south fifty four degrees forty five minutes east, one chain and seventy links, thence south thirteen degrees and thirty minutes east four chains, thence south two degrees and thirty minutes west one chain and ninety eight links to a mark on a rock 37 & one half links distant on a course of south 80 degrees & 45 minutes East to a white oak tree standing on the west side of said road, thence along the north side of the orchard owned by Myer G Beaver and along the general course of the fence south eighty degrees and forty five minutes east 7 chains and fifty links to corner of walls on the line of lands occupied by John O Beaver, thence along the line of said lands along the general course of said wall as follows, north eight degrees and thirty minutes west one chain and thirty links to angle of wall, thence north 10 degrees and thirty minutes East one chain and thirty links to angle of wall, thence north thirty degrees east (70) seventy links to angle of wall, thence north 20 degrees and thirty minutes east one chain and fifty links to angle of wall, thence north eight degrees & 30 minutes east two chains and ten links to angle of wall , thence north 12 degrees east one chain & 98 links to a point on the southerly line of Pellville farm 15 links northerly from the center of white oak tree, thence in company with the line of Pellville farm as follows, south 75 degrees west one chain and 67 links to a monument of stone in the corner of the fence thence north three degrees east four chains and twenty eight links ???? pine stumps, thence north 78 degrees west two chains and 98 links to the west side of a chestnut stump standing on the easterly side of Beaver's Creek, thence along the easterly side of said creek north 22 degrees east four chains and thirty links to a stake and monument of stone where a wall formerly stood, thence north eighty one degrees west one chain and seventy links across Beavers Creek and the private road to a stake set thence along the westerly side of said road north nineteen degrees East three chains and eighty five links to a stake standing at the southeast corner of the nursery thence along the nursery in range with a walnut tree marked north sixty seven degrees west one chain and thirty links thence north forty seven degrees west one chain to the place of beginning containing thirteen acres two roods & fifteen perches of land. Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or an any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof. And also all the estates, rights, titles interest, and mortgage which is hereby satisfied of said property, possession, claims and demand whatsoever, as well in law as in equity of the said party of the first part of in or to the above described premises and every part and parcel thereof with the appurtenances To have and to hold, all and singular the above mentioned and described premises, together with their appurtenances unto the said party of the second part & his heirs and assigns forever. And the said Clark Beaver, for himself and his heirs, executor and administrators, does hereby covenant, promise and agree to and with the Said party of he Second part and his heirs and assigns that he has not made, done committed, executed or suffered any act or acts, thing or things whatsoever whereby or by means whereof the above mentioned described premises or any part of parcel thereof now are or at any time hereafter shall or may be impeached, charged or incumbered in any manner or way whatsoever In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year first above written.
