| This indenture made the
twenty eighth day of June, one thousand eight hundred and forty four,
between Martin H Beaver of the Town of Esopus, County of Ulster and
State of New York and Eliza his wife, parties of the first part, and
Robert L. Pell of the Town and County aforesaid, party of the Second
part.
Witnesseth that the said parties of the first part for and in consideration o the sum of one hundred and thirty three dollars lawful money of the United States to them in hand paid by the said party of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged and the Said party of the Second part, his heirs, Executors and administrators forever released and discharged from the same, by these presents have granted. bargained, sold, aliened, remised, released, conveyed and confirmed and by these presents doth grant, bargain, sell, alien, remise, release, convey and confirm to the said party of the second part and to his heirs and assigns forever
All that certain lot, piece or parcel of land situate, lying and being in the Town of Esopus, aforesaid, bounded and described as follows. Beginning at a stake set in the ground for the corner of Pellville farm and is also a corner lands owned by Joshua W. Beaver & running from thence along lands owned by the parties of the first part, according to a survey thereof, made by George Van Vliet South fifteen Degrees and fifteen minutes West seven chains to a stake and monument of stones, thence south twenty eight degrees and forty five minutes west nine chains and forty links, to a point in the center of the public highway leading from the Ferry at Hyde Park to the Ferry at Rondout, thence along the center of said highway as follows: south fifty four degrees and forth five minutes East one chain and seventy links, thence south thirteen degrees and thirty minutes east four chains, thence south two degrees and thirty minutes west one chain and ninety eight links to a mark on a rock thirty seven and one half links distant on a course of south eighty degrees and forty five minutes east from a white oak tree standing on the west side of said road, thence along the north side of the orchard owned by Myer G. Beaver, and along the general course of the fence south eighty degrees and forty five minutes east seven chains and fifty links to a corner of walls, on the line of lands occupied by John O Beaver, thence along the line of said lands along the general course of the stone wall as follows, north eight degrees and thirty minutes west one chain and thirty links to angle of wall thence north thirty degrees east seventy links to angle of wall, thence north twenty degrees and thirty minutes east one chain and fifty links to angle of wall, thence north eight degrees and thirty minutes east two chains and ten links to angle of wall, thence north twelve degrees east one chain and ninety eight links to a point on the southerly line of Pellville Farm fifteen links, northerly from the centre of a white oak tree, thence in company with the line of Pellville Farm as follows: north seventy five degrees west one chain and sixty seven links to a monument of stone in the corner of the fence, thence north three degrees east four chains and twenty eight links, to a large pine stump, thence north seventy eight degrees east two chains and ninety eight links to the west side of a chestnut stump, standing on the easterly side of Beaver's Creek, thence along the easterly side of said creek, North twenty five degrees East four chains and thirty two links to a stake and monument of stone where a wall formerly stood, thence N 81 degrees West one chain and 10 links across Beaver's Creek and the private road to a Stake Set, thence along the westerly side of said road N 19° E 3 chains and 85 links to a stake standing at the south east corner of the nursery, thence along the nursery in range with a walnut tree marked N 67° W 1 chain & 30 links, thence N 47° W 1 chain to the place of beginning, containing thirteen acres 3 roods and fifteen perches of land Together with all and singular the tenements, hereditaments, and appurtenances thereunto belonging or in any way appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof. And also all the estate, right, title, interest, dower and right of dower, property, possession, claim and demand whatsoever, as well in law as in equity of the said parties of the first part of in and to the same and every part and parcel thereof with the appurtenances. To have and to hold the above granted, bargained and described premises with their appurtenances unto the said party of the second part, his heirs and assigns, to his and their own proper use, benefits and behoof forever And the said Martin H. Beaver, for himself, his heirs, executors and administrators, doth hereby covenant, grant and agree to and with the said party of the second part his heirs and assigns that the said Martin H. Beaver at the time of the sealing and delivery of these presents is lawfully seized in his own right of a good, absolute and indefeasible estate of inheritance in fee simple of and in all and singular the above granted and described premises with the appurtenances and has good right full power and lawful authority to grant, bargain and sell and convey the same in manner aforesaid. And that the said party of the second part, his heirs and assigns shall and may at all times hereafter peaceable and quietly have hold use occupy possess and enjoy the above granted premises and every part and parcel thereof with the appurtenances without any lot, suit, trouble, molestation, eviction or disturbance of the said parties of the first part, their heirs or assigns or of any other person or persons lawfully claiming or to claim the same. And that the same now are free, clear, discharged, and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments and encumbrances, of what nature or kind soever. And also that the said parties of the first part, and their heirs, and all and every person or persons whomsoever lawfully or equitable deriving any estate, right, title or interest of in or to the hereinbefore granted premises by from, under or in trust for him or them, shall and will at any time or times hereafter, upon the reasonable request and the proper charges in the law of the said party of the second part his heirs and assigns make do and execute or cause to be made done and executed all and every such and other lawful and reasonable acts, conveyances and assurance in the law for the better and more effectually vesting and confirming the premises hereby granted, or so intended to be, in and to the said party of the second part his heirs and assigns forever as by the said party of the second part, his heirs or assigns or his or their counsel learned in the law shall be reasonably advised or required. And the said parties of the first and their heirs the above described and hereby granted and released premises and every part and parcel thereof with their appurtenances, unto the said party of the second part, his heirs and assigns against the said parties of the first part and their heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same shall and will warrant and by these presents forever defend.
