| Peter G Sharp to the Church of the Ascension |
This Indenture made the sixteenth day of January in the year one thousand eight hundred and forty seven between Peter G Sharp of the town of Kingston, county of Ulster of the first part and the Rector Church Wardens and Vestry of the Protestant Episcopal Church of the Ascension Esopus in said county of the Second part Whereas Martin R. Beaver & Eliza his wife & Myer G Beaver & Hester his wife by indenture of Mortgage bearing date to the twentieth day of July one thousand eight hundred and forty six for the consideration therein mentioned and to secure the payment of the money therein specified did convey certain lands and tenements of which the lands hereinafter described are part unto the said Peter G Sharp, Which said mortgage is recorded in Ulster County Clerks Office in Book No 35 on pages 547, 548, 549, 550 And Whereas the said party of the first part at the request of the said parties of the second part has agreed to give up and surrender the lands hereinafter described unto the said parties of the second part and to hold and retain the residue of the mortgaged lands security on the money remaining due on the said mortgage Now this indenture Witnesseth that the said party of the first part, in pursuance of the said agreement, and in consideration of one Dollar, to him duly paid at the time of the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, released, quit claimed and set over, and by these presents doth grant, release quit claim and set over, with the said parties of the second part, their successors in office, all that part of the said mortgaged lands as follows Beginning
at a point in the middle of the road leading from Kingston to Newburgh
on the line of land owned and occupied by Archibald Russell and running
along said Road, North Seven degrees west two chains and sixty six
links, thence north eighty eight degrees west five chains and eighty
eight links to a heap of stones then south seven degrees west one chain
to a hemlock tree on the top of a ledge of rocks in the line of the said
A. Russell, thence along said line to the place of beginning, containing
one acre of land strict measure to be used as a burying ground To have and to hold the lands and premises hereby released and conveyed to the said parties of the second part their successors in office to their only proper use benefits and behoof forever free clear and discharged and from all suit and claim under, and by virtue of this indenture of Mortgage aforesaid In witness whereof } “their successors in office” } interlined } “heirs and assigns” } Peter G Sharp (seal) erased before execution } "of the send part” } erased also before execution. } John H Hasbrouck Ulster County } On the 16th day of January in the year 1847, Peter G Sharp, whom I know to be the individual described in and who executed the within conveyance came before me and personally acknowledged that he had executed the same M V Norton Justice of the peace A true record entered the 18th day of January 1847 at 9 h. a.m. Rich E Keaton, Esop Clerk
