| Myer and Hester Beaver to Church of the Ascension |
| This Indenture made the
twenty sixth day of August one thousand eight hundred and forty six
Between Myer G Beaver and Hester his wife of the Town of Esopus County
of Ulster and State of New York of the first part and the Rector, Church
Wardens and Vestry of the Protestant Episcopal Church of the Ascension,
Esopus, Ulster County and State of New York, of the second part Witnesseth that the said parties of the first part, in consideration of the sum of one hundred Dollars to them duly paid have sold, and by these presents do grant and convey to the said parties of the second part and their Successors in office all that certain piece or parcel of land situated in the Town of Esopus and county of Ulster bounded as follows Beginning at a point in the middle of the road leading from Kingston to Newburgh on the line of land owned and occupied by Archibald Russell and running along said Road, North Seven degrees west two chains and sixty six links, thence north eighty eight degrees west five chains and eighty eight links to a heap of stones then south seven degrees west one chain to a hemlock tree on the top of a ledge of rocks in the line of the said A. Russell, thence along said line to the place of beginning, containing one acre of land strict measure to be used as a burying ground And the said parties of the Second part to be at their expense of fencing and maintaining the fence around the same with the appurtenances and all the estate title use interest of the said party of the first part therein. And the said parties of the first part do hereby covenant and agree that at the delivery hereof they are the lawful owners of the premises above granted, and seized of a good and indefeasible estate of inheritance therein, clear of all incumbrance. And that they will warrant and defend the above granted premises in the quiet and peaceable possession of the said parties of the second part, their heirs and assigns and successors in office In witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written Sealed and delivered } in the presence of Ebeneser Ward } In the tenth line being deleted } before execution and } Myer G Beaver (seal) The words “successors in office” } inserted in the } Hester Beaver (seal) Third and fourth lines } from the bottom of the Sheet } Marisus V. Wheeler } Ulster County } State of New York } On the twelfth day of October 1847 Before me came Myer G Beaver and Hester his wife, both to me well known to be the same individuals named in and executing the within conveyance and severally acknowledged the same; before me that they had executed the same, and the said Hester on a private examination before me separate and apart from her husband before me acknowledged that she had executed the said conveyance freely without any fear of compulsion of her husband.
