Samuel and Fanny Elmore to Crowther, Gandy and Greaves

This indenture made the twenty fifth day of April one thousand eight hundred and fifty Between Samuel L Elmore and Fanny his wife of the town of Esopus in the county of Ulster and state of New York of the first part and James Crowther, Philip Gandy and George Greaves of the same place of the second part

Witnesseth that the said parties of the first part in consideration of the sum of three thousand dollars to them duly paid have sold and by these presents do grant and convey to the said parties of the second part

  All that certain lot of land situated in the town of Esopus formerly New Paltz in the county of Ulster commonly known as the factory lot of John Beaver deceased and by his executors conveyed to the said parties of the first part on the 2nd day of March 1842, and is bounded as follows

Beginning at a stone set in the ground on the east side of the public highway & factory pond northeast of the factory and opposite a stone wall and running from thence across the factory pond to the corner of a stone  wall on the west side of the factory and from thence along said wall as it winds and turns up the hill to the top of the woks(?) and southwest corner of lands by the said John Beaver deceased devised to his son Joshua W Beaver and from thence southerly as it winds and turns along a line of marked trees to opposite a stone wall running down to the mill pond and from thence northerly along said  mill pond to a wall at or near a large stump and thence across the creek east to the middle of the public highway and from thence northerly to the place of beginning

  Containing about eight acres of land with the privilege of damning the factory dam as high as usual on land; given or devised to Joshua W Beaver by John Beaver deceased as aforesaid  (Excepting and reserving thereunto Joshua W Beaver & his heirs and assigns the privilege of extending his fence to the factory dam) together with all machinery belonging to the factory and therein used and with the appurtenances, and all the estate title and interest of the said parties of the first part therein  And the Samuel L Elmore and his wife Fanny do hereby covenant and agree that at the delivery hereof they are the lawful owners of the premises above granted and seized of a good and indefeasible estate of inheritance therein clear of all incumbrance and that they will warrant and defend the above granted premises in the quiet and peaceable possession of the said parties of the second part their heirs and assigns forever

In witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written.

                                                            On the 25th day of April 1850 before me Samuel L Elmore and Fanny his wife to me known to be the same individuals named in and who executed the within conveyance and severally before me acknowledged that they had executed the same and the said Fanny on a private examination by me separate and apart from her husband and before me acknowledged that she executed the said conveyance freely without any fear of compulsion of her said husband
