This Indenture made the twenty sixth day of April in the year of our Lord one thousand eight hundred and fifty two between Eleazer Gidney of Ulster County New York of the first part and Archibald Russell of the County and State aforesaid of the second part of the same part

Witnesseth that the said party of the first part for and in consideration of the sum of one hundred dollars lawful money of the United States of America to him in hand paid by the said party of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged has remised released and quit claimed and by these presents does remise release and quit claim unto the said party of the second part and to his heirs and assigns forever 

All that certain piece of parcel of land lying in the town of Esopus Ulster County and bounded as follows

On the west by the middle of the highway leading from Kingston to Newburgh on the south by a line running from the center of said highway through a hickory tree to an oak tree marked thence southerly through a cedar tree to the old division line of lot No 8 as established by Charles Cotton & Joseph Gidney Sr thence along the said division line to the River then along said River to the lands of Solomon W Dumont thence Northwesterly along the lands of said Dumont to the middle of said highway and along the middle of said highway to the place of beginning said corner being marked and designated by stones set in the ground and also the exclusive right to and use of a certain spring of water located near the lands of Herman C Adams on the west side of the highway aforesaid the pipes leading therefrom to be laid below the reach of the plough or ordinary tillage and at the risk and expense of the party of the second part entirely

Together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in any wise appertaining and reversion and reversions remainder and remainders rents issues and profits thereof and also all the estate right title interest property possession claim and demand whatsoever as well in law as in equity of the said party of the first part of in or to the above described premises and every part and parcel thereof with the appurtenances.

To Have and To Hold all and singular the above mentioned and descried premises together with the appurtenances unto the said party of the second part his heirs and assigns forever.

On this 14th day of May 1852 personally appeared before me George T. Pierce to me personally well known and being by me duly sword deposes & says that he is a resident of Esopus in said County that he saw Eleazer Gidney execute the within Deed that the said Pierce subscribed his name thereto as a witness and that he knows the said Gidney to be the person described in & who executed the within Conveyance.
