This Indenture made the fifth day of April in the year of our Lord one thousand seven hundred and eighty three Between Michael Devoe and Elizabeth his wife of the New Paltz in the County of Ulster and State of New York of the first part and Jowell Harvey Jun of Amenia Precinct in Dutches County in the state aforesaid of the second part Witnesseth that the said Michael Devoe and
Elizabeth his wife for and in consideration of the Sum of one thousand
three hundred and seventy five pounds current lawful money of the State
aforesaid Have granted bargained and sold, aliened, enfoeffed released
and confirmed and by these do grant bargain sell alien enfeoff release
and confirm unto the said Jowell Harvey Jun his Heirs and Assigns
forever All that the one full and equal fourth part or share of a lot of land known and distinguished by the Northern Lott Number nine situate lying and being on the West side of Hudsons River within the patent commonly called the Paltz patent in Ulster County The whole lot being bounded to the North by Lot Number Ten and Westerly three English Miles into the woods from Hudsons River aforesaid and Southerly by Lot Number eight and Easterly by Hudsons River. And also another tract or parcel of Land in the County patent and Lot Number nine aforesaid the North half or thereabouts of the Lot of Land distinguished and known by the Lot Number nine in the North division on the West bank of Hudsons River the said half or parcel of the said Lot Number nine belonging also to Michael Devoe aforesaid and extending West three miles into the woods from the said Hudsons River as the same is now marked and distinguished by a stone set up in the sides thereof. And also another Lot of Land being the one fifth part undivided out of the Southernmost one fourth part of a certain Lot of Land situate lying and being within the bounds and Limits of the New Paltz Patent. Beginning at the West side of Hudson's River and runs three miles into the woods and lays between the rangeing of the Stones Number nine on the South side and the rangeing of Stones Number Ten on the North side and said Lot is known by the Name of Lot Number nine in the North division the whole to contain seven hundred & forty nine acres & a half. Together with all and singular the Houses Barns Stables Orchards Gardens Fences Woods under woods, Trees, Timber, Feedings, Pastures, Meadows, Marshes, swamps, ponds, pools, Water, Water Course, Rivers, Rivulets, Runs & Streams of Water, Fishing, Fowling Hawking & Hunting Mines & Minerals and all other profits benefits liberties, Privileges, Hereditaments and Appurtenances whatsoever unto the said above bargained premises or any part or parcel thereof belonging or in any wise appertaining And also the reversion and reversions, Remainder and Remainders, Rents and Services thereof. And also all the Estate, Right, Title, Interest, Claim and Demand whatsoever of them the said Michael Devoe and Elizabeth his wife of in and to the said premises. And of in and to every part and parcel thereof: (Except half an Acre or a little more that said Michael Devoe hath formerly sold out of the above premises unto Gabriel Garlink. To have and to hold the said Messuage Tenement and premises above mentioned with the Appurtenancess unto the said Jowell Harvey Jun his Heirs and Assigns to the only proper Use and Behoof of him the said Jowell Harvey Jun his Heirs ad Assigns forever (Except as before is Excepted) And the said Michael Devoe and Elizabeth his wife for th3emselves their Heirs and Assigns do Covenant and Grant to and with the said Jowell Harvey Jun his Heirs and Assigns that the said Michael Devoe and Elizabeth his wife now are lawfully and rightfully Seized of a good pure absolute and indefeasible Estate of Inheritance in fee simple And also that the said Michael Devoe and Elizabeth his Wife now have good right full power and lawfull authority in their own right to grant Bargain sell and convey all and singular the said premises above mentioned (Except what is before Excepted). And also that the said Jowell Harvey jun his Heirs and Assigns shall and may at all Times forever hereafter peaceable and quietly have hold, occupy possess and enjoy all and singular the said Messuages Lands Tenements and premises above mentioned with the Appurtenances without the Lot, Trouble, Hindrance, Molestation, Interruption and denial of them the said Michael Devoe and Elizabeth his wife, their Heirs or Assigns and of all and every other Person and Persons whatsoever claiming or to claim by from or under them or any of them (except as before excepted) And Further that the said Michael Devoe and Elizabeth his Wife and their Heirs and all and every other Person and Persons and their Heirs any Thing having or claiming in the said premises above-mentioned or any part thereof by from or under them (Except as before Excepted), shall and will from time to time and at all Times hereafter upon the reasonable request and at the costs and charges of the said Jowell Harvey Jun his Heirs or Assigns make do and execute or cause or procure to be made done and executed all and every such Further and other lawfull and reasonable Act and Acts, Thing and Things, Devise and Devises, Conveyance and Conveyances in the Law whatsoever for the further, better and more perfect granting conveying and assuring of all and singular the said premises above-mentioned with the Appurtenances unto the said Jowel Harvey Jun his heirs and Assigns to the only proper use and behoof of the said Jowel Harvey Jun his Heirs and Assigns forever, according to the true intent and meaning of presents as by the said Jowel Harvey Jun his Heirs or Assigns or his or their Council learned in the Law shall be reasonable devised or advised and required (except as before excepted) And I the said Michael Devoe for myself my Executors Administrators all and singular the said Land and premises unto the said Jowel harvey Jun his Executors Administrators and Assigns against me the said Michael Devoe my Executors Administrators and against and against all and every other Person and Persons whatsoever shall and will warrant and forever Defend by these presents. In Witness whereof have hereunto set our Hands and Seals the Day & Year first above written Signed Sealed & Delivered Interlineations

that the eight Day of April in the Year of our Lord one thousand seven
hundred and eighty three personally appeared before me Direk Wijnkoop
Esq one of the Judges of the Court of Common pleas for said County of
Ulster Michael DeVoe and Elisebeth his wife parties to the within deed
and acknowledged that they had executed the same by signing Sealing and Delivering
the same as their Voluntary Act and Deed for the uses therein mentioned
and I have examined the said Elizabeth separat and apart from her
Husband or any other Person and she acknowledged that she had executed
the same of her own free and voluntary will and accord without any Persuasion
or Compulsion from her Husband or any other Person. And I have
perused the same and find no material erasures or interlineations there except
such as where noted to have been done before Executing the same
wherefore I do allow the same to be Recorded A true Recorded entered at the request of Mr. Jowell Harvey |
